Massachusetts politician and defense attorney Rep. James Fagan is under intense public scrutiny after he promised to "rip apart" child victims of rape who testify if the state imposes strict sentences for sex offenders.
Fagan, a Democrat, made his controversial remarks on the state House floor, Fox News reported.
"I'm gonna rip them apart," Fagan said of child victims. "I'm going to make sure that the rest of their life is ruined, that when they're 8 years old, they throw up; when they're 12 years old, they won't sleep; when they're 19 years old, they'll have nightmares and they'll never have a relationship with anybody."
As a defense attorney, Fagan said he would prevent accused child sex offenders from experiencing a "mandatory sentence of those draconian proportions."
According to the report, his statements angered both colleagues and activists.
"I thought his comments were over the top and unnecessary," said Bradley Jones, Massachusetts House minority leader. "I appreciate that he's a defense attorney, and felt he had a point to make, but I think it was unnecessary. It was excessive."
Mark Lunsford, a Florida father who lost his 9-year-old daughter after she was kidnapped, wrapped in a trash bag and buried alive by a sex offender in 2005, said he was shocked by Fagan's remarks. He told the Boston Herald that Fagan should have more respect for the rights of sexually abused children.
"Why doesn't he figure out a way to defend that child and put these kind of people away instead of trying to figure ways for defense attorneys to get around Jessica's Law?" Lunsford asked. "These are very serious crimes that nobody wants to take serious. What about the rights of these children?"

Well with DEMS everything is “for the children”
...apparently that includes dirct threats of livelong terror from RAT politicians.
any follow up to this story? is it now history? if he had an R next to his name, would it still be news?
If he thinks any crime victim advocate or judge would tolerate that behavior, he hasn’t been in court for the last 20 years. The children are shielded, and the Judges will sometimes question them in chambers with defense watching by monitor.
I can assure you that if he remains true to his word one of those kids is going to eventually come after him.
Take that to the bank. Way too much anger already in a victim of childhood sexual abuse.

Does Fagan endorse Mr B.O.? What’s Mr B.O.’s position regarding this issue? Will the MSM ask such questions? probably NOT
There are two possibilities here...
Either Fagan is offering a warning that defense attorneys will have no choice but to go for broke and attack the victim once all discretion has been removed from the proceedings, or...
Fagan is admitting in public for attribution that he likes to abuse child rape victims for fun.
If everybody here and at WND wants to assume the latter, that is there business. It makes for great headlines and who doesn’t enjoy getting all into a lather about the abuse of children. I kind of suspect that former was the point he was trying to make, however.
There’s got to be a middle ground between what this lawyer is proposing and what happened in the McMartin Preschool case, where victims couldn’t be cross-examined at all.
I have some real problems with our legal system. Justice at time comes at the expense of the innocent as we bend over backwards to protect the rights of the accused. In others parts it seems justice comes to the one who can afford to buy it.
Ummm.... He sure seems to spend a lot of time around little boys, doesn’t he?
You would think that that would foster empathy for them, but the way this guy is acting I am thinking he has another motive to hate mandatory sentences than just his profession as a lawyer.
Reflection on his chosen profession - criminal defense attorney.
Freepers are so easy to get lathered. Of course this man is making the point of the unintended consequences of the law and conservatives are supposed to be the first in line to consider that. Instead, many of us rather get all emotional.
You really have to see this guy on a U Tube video, He should be put in a straight Jacket and his license to Practice taken away.
This S.O.B. should be recalled from the Massachusetts State Ligislature, he is dangerous.
Scary that a bastard like this is involved with all those children’s organizations and strangely, only children’s organizations.

Why does Fagan think it’s more important to protect children from lawyers than from child rapists?
someone needs to run against this guy and play this tape over and over again.
When it comes to protecting children, you’re either with us or against us. It’s clear where Fagan falls. I just can’t understand how anyone could be
Yes, but the Massholes will probably re-elect him in a landslide.
Uh oh. too many connections to youth groups.
The poster who thought he ought to be investigated has it right.
Very scary.
Fagan’s rant sounds like those who say we shouldn’t fight back against Islam because they might get mad at us.
