I believe our forefathers thru the 2A reafirmed our right to both keep and to bear arms as an individual right. And I don’t believe they restricted that right to our homes. None of our other rights apply to us only while in our homes.

Thanks for a great post. The Court's decision in this case could be the most important one in the history of our constitution. My fear is that their vote will be along the same line of the recent “Habeas Corpus” decision. Our republic is in danger

Puhleeze. You might get a 1500 post thread on FR, the Levinites will post 152 pictures of beverages on their thread, and the next day, they'll all answer their doors and hand over their guns to the SWAT team at the door.

In that scenario, it means the majority of Americans rewarded the Democrats as well as elected a straight-up Marxist to the presidency, so how much support are we gonna have to fight this? "Hope for the Change of Gun Confiscation for the Children!"

I wish so much that you were right, but the fact that we're waiting and even allowing the Judicial Oligarchy to decide what rights we have or don't have is proof enough that there will be no 3rd* revolution.

(The second American Revolution was put down by military force in 1865.)

Maybe the Justices who vote against an individual right should be impeached, regardless of the outcome of the case?

I agree. I don’t think that we could have all been wrong in relation to how we view the 2A for over 200 years. Maybe a new 2nd Ammendment should be written explaining this and leave no doubt as to what the words mean.

Absurd....That's not our form of government.

Besides, self protection, hunting etc.. supercedes the Constitution.

George Washington said the arms that were supplied to the troops should be given to them for their own use...as a way of compensating them for the lousey pay structure that was going on. Have the letter in an old book.

Why would it take a month for the Second American Revolution to start after a nationwide gun ban?

I don't think the Supremes will vote that we don't have an individual RKBA. The worst they will do is not give a standard for how to determine the Constitutionality of other gun regulations.

I’ve had good confidence that Heller would come down as a landmark case ~improving~ our gun rights under the law. After the decision on military prisoners, though... my confidence is badly shaken. Now it’s a total craps-shoot.

If Heller goes badly one immediate effect will be that suddenly gun control jumps to the top #1 campaign issue, having been largely ignored until now.

Will enough people trust a wholly democrat congress with crafting new draconian gun control laws? Maybe not.

That's interesting. Did they get to keep them? It would make sense. They're the militia, after all. Makes better sense than just stacking them up in some weapons depot somewhere. They'd just have to re-issue them if something came up.

Finally, some good news. For the first time in 30 years the Court will actually be acknowledging the Rights in The Bill of Rights. It will be a great day.
