"Justice Scalia is right that todays opinion will result in the death of Americans. His words remind me of the beleaguered FBI agent, Harry Sammit, who pleaded with his superiors at FBI headquarters to be allowed to launch a nationwide manhunt for Khalid al-Mihdhar and Nawaf Al-Hazmi, two of the hijackers on my brothers plane, 3 weeks before 9/11. He was turned down by the lawyers in the National Security Law Unit of the FBI, who cited the FISA law that prevented this intelligence information from being used by the criminal division. The point of that law known as the wall was CIVIL LIBERTIES protection for the terrorists who were the object of that never-launched manhunt, should they ever be caught and brought to trial. Sammit wrote in an email, on Aug. 31, 2001:"

I don’t agree with the court decision, but this article is really an exaggeration.
All the decision says is those held have the right to go to court. The government can tell the court “this is an enemy combatant captured on the field of battle”, and if they have any evidence to support that they will prevail.
In the future, our forces will turn over any captives to our local allies, or simply do their best to “take no prisoners”.
A much greater threat to our soldiers are the bogus charges brought against them that have disgraced and dishonored the legal services of our armed forces. Why would anyone wish to defend the USA, just to be charged with a crime for doing their duty?
The enemies of freedom can not win on the battlefield so they will rely on the courts to give them the competitive advantage... and so far, they seem to have done quite well.
This is really great but I’m afraid it is “preaching to the choir”. Too bad this wasn’t printed in all the major newspapers and on the Yahoo news (instead of the AP propaganda that everyone gets when they check their email).

if Congress did it’s job and defined the rules of conduct for the war and military, then SCOTUS wouldn’t have to be involved.
Like everything else, Congress won’t take a stand (abortion, gay marriage, etc) and instead leaves it to an unelected and unaccountable court to make the decisions that Congress should be doing. Spineless legislators not doing their duty. And this is truly a bipartisan problem.

This is good news for the poor al Qaeda fighters. Things just weren't going very well for them the past year or so.
If they can just hold on for a few more months, they will be able to claim victory in both Afghanistan and Iraq.

Theye were living six miles from me here in San Diego and one of them was in the 2000 phone book.
Of course we all found out after the fact.
In this case, they did. They did it in response to previous Supreme Court decisions.
But SCOTUS didn't care about all that, and stuck their oar into those waters anyway.
