McCain: Guantanamo Ruling One of the ‘Worst Decisions’ in History
Fox News ^ | June 13, 2008 | Foxnews.com

Posted on 06/13/2008 12:09:36 PM PDT by DCRoush

John McCain said Friday that the Supreme Court ruling on Guantanamo Bay detainees is “one of the worst decisions in the history of this country.” The presumptive GOP nominee said the decision, a 5-4 ruling Thursday that determined Guantanamo detainees have the right to seek release in civilian courts, would lead to a wave of frivolous challenges. “We are now going to have the courts flooded with so-called … habeas corpus suits against the government, whether it be about the diet, whether it be about the reading material. And we are going to be bollixed up in a way that is terribly unfortunate because we need to go ahead and adjudicate these cases,” he said at a town hall meeting in New Jersey. McCain said he has worked hard to ensure the U.S. military does not torture prisoners but that the detainees at Guantanamo are still “enemy combatants.” “These are people who are not citizens. They do not and never have been given the rights that citizens in this country have,” he said. “Now, my friends, there are some bad people down there. There are some bad people.” Barack Obama released a statement Thursday saying the Supreme Court decision “ensures that we can protect our nation and bring terrorists to justice while also protecting our core values.” “The Court’s decision is a rejection of the Bush administration’s attempt to create a legal black hole at Guantanamo - yet another failed policy supported by John McCain,” he said. “This is an important step toward re-establishing our credibility as a nation committed to the rule of law and rejecting a false choice between fighting terrorism and respecting habeas corpus.”

“After all, he has a very long history of supporting a ruling of this type.”

False. McCain voted for the legislation (S.3930) that defined these terrorists as unlawful combatants and establishes [military commissions for the trial of alien unlawful enemy combatants.]

The legislation that McCain voted for ‘prohibits an alien enemy unlawful combatant from invoking the Geneva Conventions as a source of rights during his trial by a military commission.’

It was Obama that opposed this legislation.

” he (Obama) may actually wind up not being able to pass as much leftist policy as McCain will overall.”

Since only two candidates have a chance of winning, do you want Obama to win, or do you want McCain to win? Also, since Obama has voted against funding for the troops mulitple times, what would prevent Obama from vetoing any additional funding for troops serving in Iraq, wich would force our defeat and hand Iraq to al-qaeda and Iran?

“Correct me if I’m wrong but doesn’t Habeas Corpus mean, ‘produce the body?’”

Literally. But legally it means. “Hey I’m this dudes lawyer and I want to make sure he is getting his Constitutional Rights.’

I will never use my vote to support a leftist like John McCain. You can read that any way you like.

“Are we to stop prosecuting the WOT? Or are we to bring the prisoners to then continental US — where they might have been subject to the same kind of horseshit SCOTUS decision as came down?”

They’ve conducted military tribunals and subsequent executions of unlawful combatants within the U.S. before. McCain voted for legislation that ensured that these terrorists would be classified as unlawful combatants and subjected to military tribunals.

As to what to do with future ones? I am not 100% on where he stands on that but I think he wants them in the prison of Fort Leavenworth. Do not quote me on that though.

Appreciate your taking my response in the good natured vein that was meant.

I suspect you are right about Fort Leavenworth. But the very reason (as openly stated, I recall) for Guantanamo was to keep the terrorists offshore -- out of the reach of the federal court system!

This was, I suspect, one of the (unstated) reasons for the majority's decision. Guantanamo is the object of an undeclared war between the Executive and the Judiciary.

McCain seems blissfully unaware of this conflict. And/or totally clueless about what to do with future prisoners.

Here you go. Once any person goes into CONUS he can demand a writ. This is what McCain’s assinine closing of GITMO would result in. The SOCTUS stole his thunder.

It is truly amazing. That ,one, McCain is so ignorant and, two, these bastards get the same protections you and I do if we hold up a bank. But under the UCMJ our troops do not get these.

McCain is an idiot.

Let’s all tear McCain down until we end up with Obama. We’re already hearing about death threats for those who do not like him.

“McCain voted for legislation that ensured that these terrorists would be classified as unlawful combatants and subjected to military tribunals.”

McCain can vote for what he want, but he is too stupid to figure out the ramifications. There is case law that says any CONUS detainee gets the rights to a writ.

This doesn’t answer my questions regarding your comment.

(Note: These are simplistic questions. Your failure to answer them is very telling)

Exactly. You can’t trust McCain. He just has no idea what he is talking about. He does this all the time.

The only thing simplistic about it, is that you are to f’n dumb to understand that I am not going to vote for John McCain. I have never supported leftists and I’m not going to start now. Now if you’re not as stupid as you have proven to be to this point, you figure it out for yourself.

“I thought Mcpain wanted to follow the GC concerning the terrorist?”

We are folling the Geneva Convention. The Geneva Convention protects lawful combatants. The legislation that McCain voted for classifies these terrorists as ‘unlawful combatants’. Therefore they are prohibited from having the same rights as lawful combatants. (Until this SCOTUS ruling, which McCain has denounced and Obama has praised)

“Let’s all tear McCain down until we end up with Obama. “

How about let’s not be stupid. Why does McCain get a pass? Anyone running for President should get a solid vetting. I’m in favor of equal treatment. I loath Obama and his fans but McCain is barely better. Do we just all dumb down?

Not me.
