Self-Defense Castle Doctrine Moves Forward (OH)

COLUMBUS, Ohio -- Self defense or an excuse for murder? It's the question state lawmakers have debated for months when it comes to an intruder storming your home.

The House approved several Senate amendments on Wednesday and the Castle Doctrine may now become law.

Senate Bill 184, the conceal carry Castle Doctrine, has a wide range of support in the statehouse, including backing from Ohio's top leader, NBC 4's Matt Alvarez reported.

"The bill as I understand it, in its current form, is something I will support," said Gov. Ted Strickland.

If made law, the bill will clear up current law when it comes to when and where you can carry a firearm and also give you the legal right to use force in your home or car against an intruder.

It will be presumed that you acted in self defense unlike the original law, where citizens had to prove reasoning for taking action.

"The Castle Doctrine essentially states what many believe to be law, the right to protect yourself and your family," said Sen. Keith Faber. "The presumption is if someone is illegally in your home, they're there for a bad purpose."

There is opposition to the legislation. The Ohio Prosecuting Attorney's Association said that current law is sufficient and homeowners are rarely charged with murder for opening fire out of fear.

The Ohio Coalition Against Gun Violence calls the Castle Doctrine a "license to kill."

But area resident Paul Lofton has a different take.

"That's what you're put in the house for, to protect your family. So if someone is coming and threatening your family, then you should be able to take force," Lofton said.

FOP president Jim Gilbert said will confuse residents, saying the current affirmative defense method is more reliable.

Ted Strickland is fantastic! He's done more for gun rights in Ohio than his predecessor, RINO Bob Taft ever did. I can forgive he's a Democrat. I look forward to his signing the Castle Doctrine Bill when it arrives at his desk.

Worthless Bob Taft never met a gun law he didn't like. Strickland has common sense and is one of the few Democrats who understands the importance of gun rights.

Castle Doctrine is a good thing FOR THE GOOD GUYS acting in self defense !

It’s working FINE in Texas and I believe in Florida.

I swear...I read an article about the CD a few months that started off the exact same way. Hey, if you don’t want to get “murdered”, don’t trespass.

Its just where you have a lawful right to be, whether its your home, your car, at work, or dining in a restaurant or walking on a public street and someone attacks you there, its going to be presumed your use of force to repel the attack was a lawful act of self-defense. The police and prosecution have to show it wasn't.

We don't. Its just the previous law had the requirement you remove yourself from the premises before you could defend yourself. Its absurd and I'm glad to see its being repealed across the country.

Considering the fact that, citizens have as much to fear from bad guy intruders,as they do from no knock warrants cops, I can see that FOP has worries.

I wouldn't go that far.

But to the extent that the donkeys really appreciate the Second Amendment, it really hurts the GOP with single issue pro RKBA types and small 'l' libertarians.

If Heller goes the right way on a strict scrutiny basis, which is what I hope for, the conservatives will have lost a lot, not unlike welfare reform. It won't be much of an issue anymore.

Depending on what planks are written for the GOP platform and the results of the general election, I wonder what the GOP will be standing for. It's too late to change horses now. One of the major parties should join the Whigs in the history books. I hope it's the donkeys.

That is what kills me about these big government, country club RINOs. They violate the principle of limited government and personal liberty. Then they wodner why poker players and gun owners are looking at democrats again.

Taft, Dewine and Voinivich has set the Republicans back quite a ways in Ohio.

We let some liberal [expletive deleted] politicians take our rights away from us, hence, we need a new law to return our rights.

Yep. More reliable for a gun-grabbing county prosecutor to string up the homeowner.
