SAN ANGELO, Texas - A state appellate court has ruled that child welfare officials had no right to seize more than 400 children living at a polygamist sect's ranch.
The Third Court of Appeals in Austin ruled that the grounds for removing the children were "legally and factually insufficient" under Texas law. They did not immediately order the return of the children.
Child welfare officials removed the children on the grounds that the sect pushed underage girls into marriage and sex and trained boys to become future perpetrators.
The appellate court ruled the chaotic hearing held last month did not demonstrate the children were in any immediate danger, the only measure of taking children from their homes without court proceedings.
Lady, this is America where you do not have to PROVE a Damn thing to the state. The burden of proof rests 100% upon the state and they must prove it BEYOND any reasonable doubt.
THAT is America.
Or the America SOME of us are fighting for...
As it clearly seems to NOT be your kind of America.
Here's to "decent debate," my FRiend.
There is a wonderful old addage:
FOLLOW THE MONEY!
Yeah, so do I... but I'm not sure which is worse here. And I'm leaning against the cult.
I can imagine it now.
CPS: Now, Johnny, just tell us how many times you saw your uncle go in the room with 14 year old Susie, and we’ll let you go home to your mom...
Government is a fearful master.
Ben Stein’s take on it:

Now I REALLY want to see his movie.
AH...but in addition to those, I got the "holocaust denier" ribbon pinned on me!
Some sad little people.
We must look to ourselves or we are doomed as a free people.
You got boogiemen hiding in the closet? You convict with no facts and then create sensational ideas in your head.
Yep..... catch me once with your illegal search but not the 2nd time. I’d be outta the state as quickly as my children were in my possession. Maybe they will be dumb enough to hang around and let the CPS and others get another shot at them....
In any case the Texas Court system is working through the appellate process. Let’s see how it all comex out; as is, appealed to the Texas Supreme Court or some other solution.
oops..that (#614)
Not to worry this thread it growing so fast its easy to loose ones place.
“Sad part is that many of them seem to actually want the allegations and falsehoods to be true for some sick, twisted, demented reason.”
It is no more true than saying you are blaming everything on the government, because you want the FLDS to continue raping children.
Others believe that Texas had reason to step in and investigate, and that removing all the children was the only choice considering the circumstances.
Once this ‘custody’ stuff is settled, and I don’t really care ‘how’ as long as it is legal, then we can get to the meat of the matter.
If the evidence is there, then get on with the arrests.
If not, then Texas and CPS are going to find the one thing they wanted to stop, will be ‘out of their reach’ from now on.
Each child is getting a custody hearing, and even with this appellate court ruling, coming to a conclusion as to what ‘will’ happen is really just gambling.
I used to really like Ben Stein, but since all of the lies and misleading of his movie, I’m torn. :-(
“Okay, so maybe I went a bit overboard...I know that would never happen in America...but do you get my point?”
Oh, well said.
GOOD GOD! I can’t believe the Government loving folks here one iota.
Awesome Post from FOX news !!
Thanks !!

And the article clearly states
” Texas Child Protective Services workers were expected to file family service plans in court late Friday, outlining what parents must do to be reunited with their children.
“The judges will be looking at the plans of service. There will be discussion regarding what the agency and parents are trying to do together in an attempt to have the children safely returned to the parents’ care at some point,” said Marleigh Meisner, a spokeswoman for the government agency.”
