Is a FL and MI "Do Over" Legal? (Vanity)

If the Democrats have some form of "do over" election for Florida and/or Michigan, it presents a problem. Although it can be said that since the first election votes didn't count, voting again isn't actually voting twice in the primaries.

However, particularly in Michigan, Kos and others were actively pushing Democrats to cross over to sabotage the Republican process. Democrats who did cross over ALLREADY had their votes counted in a valid election. Will they now be allowed to vote a second time? This would violate the rules of both parties and establish a precedent for being able to vote in each parties primaries.

It would be possible that the independents in FL that gave us McCain would now be able to decide to give us Hillary too.

A small group of wishy washy nobodies in Florida could decide the whole election.

Why not? The precedent has already been set

Democrats in Florida vote in their home state by "mail in ballot" and in Florida by the regular way.

Aren’t the parties private political groups?
If so, what does it matter?
I don’t belong to, or owe, neither of them anything anyway.

The Constitution is silent as to how parties choose their nominees. The Dems can choose their nominee by state or national conventions, primaries, caucuses, appointment by the national party committee, or a big game of pin the tail on the donkey, which might be most appropriate.

The Dems can "change the rules in the middle of the game" if they choose. Any candidate who feels wronged can sue (I understand John Edwards is available), but I doubt a lawsuit would go anywhere.

Hildabeast would benefit in any MI do-over as long as its a primary and not a caucus.

If they exclude the RATS that crossed over...they were the Osama obama voters anyway, a plus for the beast.

If they let everyone vote again...huge Republican crossover for the beast, another plus for the beast.

Because of the fact that Michigan hasn't had party registrations for many years they can't have a do-over without crossover or screwing their own RAT base.

Eligible delegates at the Dim convention has nothing to do with the law and has everything to do with what the Dims decide they want to do.

Will the other candidates who had not dropped out yet, be allowed to have their names on the ballots... I cannot remember when Edwards dropped out but it was after the michigan primaries I think.. and he offically dropped out after clinton proclaimed her winning florida.. so that could change the dynamics for the race...

Just keep in mind the golden rule, “he who as the gold makes the rules” and the DNC has the gold. It would seem to be they can do whatever they want but I would like them to pay for the “do over”, “vote till ya’ get it right.”

I think primaries, are pretty much exempt from any sort of regulations.

However dems (or the GOP for that matter) decide to run primaries and decide their candidate - it’s nobody else’s business.

Speaking of which. Anyone else think the solution to what happened to the GOP this year, might just be to have Republican “super-delegates”, might help to prevent another result like this one?...

According to a dem, "illegal" is only something they don't approve of, or a sick bird. Laws, or for that matter, right and wrong, have nothing to do with anything.

What would stop Republicans from showing up in Florida for a do-over?

They could just say they want their votes to count and to be a part of the process. Let's see the Dems deal with that!

It is certainly legal for them to do what they wish. The parties make up their own rules. I think it is overall just for show because it will not make a real difference in the end. The delegate distribution isn’t likely to change much.
Hillary will not win by the margins she did when she was the only candidate campaigning and Obama has a real chance of taking Michigan on a do over. He won 40% as uncommitted with his name not on the ballot. The do over actually serves Obama more than it serves Hillary. Seating the delegates as is would serve Hillary more though it would set fire to the Democrat party and probably represent a Hover moment for the party concerning Blacks. The Democrat party can not afford to alienate black voters by appearing to have favored a white woman unfairly by changing the rules on a whim.

Ask the Democrat Party from NJ. As long as it helps the Democrat Party, of course it is legal and don't you dare ask any questions like that again.

Any sort of do-over in any open primary state is totally unworkable when Republicans already have a candidate.

The RATS are just screwed this time by the very rules they demand so they get to screw up the Republican primaries.
