A state appeals court rejected a discrimination suit Wednesday by a white man who was replaced by an African American as a news anchor at Bay Area NBC affiliate KNTV, saying station managers were concerned about his on-the-air style, not his race.
Brad Hicks, one of several anchors whose contracts were not renewed in 2003 after NBC brought in new management, said in his suit that he was more qualified than his successor and that KNTV had bowed to pressure to hire more minorities. But the Sixth District Court of Appeal in San Jose, upholding a judge's dismissal of the case, said Hicks failed to back up his claims.
"There is no evidence of any kind to suggest that anyone at KNTV was dissatisfied with (Hicks) because of his race," said Justice Eugene Premo in the 3-0 ruling.
Instead, Premo said, the station kept some of its white and minority anchors, dropped others, and hired replacements without regard to race. A station executive found Hicks' performance style "aloof, distant, standoffish, unapproachable, stiff," and Hicks was unable to show that his assessment was a pretext for discrimination, the court said.
Hicks' lawyers were unavailable for comment.
KNTV hired Hicks in 2000. NBC bought the station in 2002 and made it the network affiliate for the Bay Area. Hicks was then the 5 p.m. news anchor on weeknights, was a reporter for the 11 p.m. newscast and hosted "Wine Country Living," an entertainment and lifestyle program.
James Sanders, the station's vice president for news, decided not to renew Hicks' contract the following year. Sanders said he had received calls from viewers complaining about Hicks' performance and had conveyed his criticism in conversations with Hicks. The anchor denied having any such conversations.

I am not sure if giants are a “protected” class but I am sure they were just covering themselves for the future!

News anchor is a unique job. It is like an actor. Part of the qualification is determined by the sex, age, race, etc. that the station wants to be it’s “face” to the viewers. It matters - and should.
If he was a machine press operator he may have won.
