SHould McCain resign from Senate?

Title 16. Article 3.

222.C. For a vacancy in the office of United States senator, the governor shall appoint a person to fill the vacancy. That appointee shall be of the same political party as the person vacating the office and shall serve until the person elected at the next general election is qualified and assumes office.

If the statute above is current, then yes Napolitano would have to appoint a Republican (yes she could appoint a RINO)...

but yes if McCain resigned upon securing the nomination, then presumably the office could be filled in November.

The filing deadline in Arizona for the September 2, 2008 primary is June 4. The governor might have some additional wiggle room beforehand. The Idaho primary is May 27. If McCain resigned on May 28 I would think the governor would probably still schedule the primary.

There are only 3 other contests that McCain would have to compensate for:

June 3 New Mexico R Primary
June 3 South Dakota D&R Primary
June 28 Nebraska R State Convention

If McCain does clinch on or before May 28, I would recommend that he resign. It will help him get a more favorable vote in the Senate, should he win the Presidency. It would also free up time for him to concentrate on winning the Presidency.

Were he to be elected President, and only then resign, the Governor (a Democrat) would name a "temporary" replacement who would, in reality, serve out McCain's remaining term. This person would have to be a registered Republican,

Unless Arizona law states it, I don't think the Governor is required to replace McCain with another Republican

With no runoffs in AZ, if the seat warmer won a plurality in a wide-open primary, they could end up toast in the general... Although with McCain on the ballot, we’d probably hold it. Even Goldwater carried Paul Fannin across in 1964 for his open Senate seat (although Richard Kleindienst lost the Governorship to Terry Goddard’s father).

They should. And they should need to do so when seeking any elected office. And there should be term limits.

Alas, it is not so.

Sure worked great for Bob Dole didn’t it?

I wish it would work as well for Hillary, Obama and John....which means somebody else would be president. OK by me.

No amount of preparation is going to help McAmnesty win the general election.

He has angered too much of the base and gone way too much to the left.

The best the GOP can do now, is plan for 2012. By that time, the country should be completely sickened by the rule of the Democr*ps and ready for a REAL change.

I think all elected Officials who run for another office should resign when they file to run for the secondary Office.That means McCain Biden Dodd Tancredo Obama Clinton and the Like..we would get some healthy turnover and the Bloviators could decide if they want to fail as Candidates or try to excel as a Senator and we wouldn’t have to foot the Bill for all these egomaniacs

He, like Obama and Hillary should not run as senator again if they’re running for pres while in office. They’ll get done with this just in time to start their senate campaign. It’s absurd. This is twice for McCain. The only thing he’s taken time in the senate to bother with is amnesty and drugs in baseball.

Think about this. The approval rating of congress is in the low 20’s. Eighty percent of the country thinks the House and Senate stink! The 3 ‘TOP’ candidates are all from the Senate, the slimiest elitist club ever known to man. Those three, McCain, Obama, and Hillary have been campaigning for the last 4 years instead of doing their job! Two of them are lawyers and that ought to disqualify them right off the bat. And McCain, well, he’s off the bat, too. And someone wants to promote them?
How does this make ANY sense?
