The Constitution is Not a “Living, Breathing Document”

This morning I heard that one of the other candidates commented that the Constitution is a “living, breathing document.”

Frankly, I assumed this came from Senator Clinton or Senator Obama. It is identical to what Al Gore said when he was running for President in 2000, when he said he would look for judges “who understand that our Constitution is a living, breathing document, that it was intended by our founders to be interpreted in the light of the constantly evolving experience of the American people.”

Imagine my surprise when I learned that this statement actually came from my opponent, Governor Huckabee, in an interview with CNN this morning. Now I know Governor Huckabee was talking about amending the Constitution, but I don’t think he understood that he was using code words that support judicial activism.

Huck and McCain have very similar positions on the constitution— something to twist as they see fit. That’s why they are running as a tag team. That’s why they both need to get out of the race and make room for Fred.

It’s a contract.

You are exactly right. And that process does not include judges making law from supposition.

If it really were “living and breathing” the libs would have already taken it to the vet to be neutered by now.

I like that Fred took the time in this case to acknowledge what Huckabee was talking about, before blasting him for the way he said it.

I don’t know about the rest of you, but even aside from the immorality and injustice of judicial activism and the “living constitution view” ... it is just downright ignorant, illogical and STUPID. I just have to shake my head when I hear somebody supposedly smart and educated espousing it.

There is a definite parallel between those who believe that the Constitution is a “living, breathing document” and those who believe that the Bible is a “living, breathing document”. In both cases it turns out that believing that these documents are “living and breathing” usually means that we can ignore the original meanings, context, and intentions of the writers and substitute whatever we want as time goes on. As a Baptist minister of the Gospel, I would think that Huckabee would be aware of the dangerous approach he is advocating.
