Spitzer Grants Pardon To Illegal Alien Posted on Sunday, 23 of December , 2007 at 7:36 pm ALBANY—Gov. Eliot Spitzer ignored requests for executive clemency from scores of New York residents, some receiving unjust sentences under the Rockefeller Drug laws while others were convicted under extreme mitigating circumstances.

Instead, he granted a full and unconditional pardon to an illegal alien to prevent his deportation.

Spitzer seems to have a thing for illegal aliens, proposing this fall to give them driver’s licenses. One day after a Siena College poll indicated that 70 percent of New Yorkers opposed his license plan and numerous lawsuits were filed to prevent the implementation of such his proposal, Spitzer shelved the plan.

On Friday, Spitzer pardoned Frederick Lake, a native of Jamaica who served a six-year sentence after a 1991 conviction for first-degree robbery. Lake has been living in Brooklyn with his wife and sons since 1997.

Lake, who entered the United States legally in 1987, faces deportation under a federal statute that mandates the removal of a lawful resident alien who has been convicted of an aggravated felony. However, the federal statute explicitly allows a Governor to prevent the deportation by granting the alien a full and unconditional pardon.

“Mr. Lake has fully served the sentence imposed upon him for his robbery conviction,” Governor Spitzer said. “He had a perfect disciplinary record while in prison, he has had no other arrests or convictions during his lifetime, and he has been living safely and without incident in the community for the last 10 years. No purpose would be served by separating Mr. Lake from his many family members who are United States citizens, including his wife and two young sons”, Spitzer said.

Lake was convicted of committing an armed robbery of $103,000 from a payroll delivery car in May 1989, and was sentenced to a term of six to 18 years in prison. Lake was released to parole on July 15, 1997, after his first appearance before the Parole Board. Three years later, he was granted an early discharge from parole supervision. Since his release from state custody, Lake has been living in Brooklyn with his wife and sons.

Lake was gainfully employed until shortly before his arrest for this robbery. Since 2003, he has suffered from significant health problems that prevent him from working, but allow him to be the primary caregiver for his sons while his wife works as a home care attendant.

Lake was born to a Jamaican mother and a United States citizen father. In a September 2000 decision, a federal appeals court deemed Lake to have been a United States citizen at birth, as a result of his father’s citizenship. The U.S. Supreme Court subsequently vacated that determination, but Lake has continued to challenge of his possible removal from this country.

At his trial, Lake presented evidence - an airline ticket and a passport stamp - which showed that he had traveled to Jamaica four days before the robbery and did not return until many months later. The prosecutor called a Jamaican immigration officer who challenged the reliability of that evidence. After an investigation into that immigration official’s testimony, the Jamaican Ministry of National Security concluded that the testimony was “faulty” and that Lake may have suffered a serious miscarriage of justice if the jury relied on it.

I’m reading that the guy entered the U.S. legally, not illegally in ‘87, and there seems to be some question about the reliability of the Jamaican immigration officer whose testimony the jury obviously relied upon in convicting the accused.

I don’t like Spitzer one iota, but he may have actually made the right decision in this case, as I see it.

What is it with politicians, of all stripes, and their love affair with illegal aliens? I guess they’re having to be blatant in their sucking-up to them and doing everything they can to make the “immigrant” demographic a large one quickly, because they’ll be dead first if they wait for it to just happen through declining American birth rates. They sure must want those votes.

How can he apply U.S./N.Y. State Laws to a non-citizen of either?

Smacks of illegality and should be cause for dismissal, or arrest!

The New York Governorship is the place where promising politicians so deemed by the MSM go before they fall off the face of the earth. What elected office did Mario Cuomo or George Pataki ever hold after their governorships?

However, Franklin D. Roosevelt was once the Governor of New York.

And then there’s Nelson Rockefeller, who was Vice President under Gerald Ford.

spritzer is doing us a great favor. Shiite like this makes it harder for the rat to take the NYS senate over - and yes fellow FReepers from around the coutry, in NYS we STILL hold the senate.

Spitzer adores those who assuage his rich man’s liberal guilt..but raises taxes on everyone else who has to work for a living. Man what a budget this year! ~ Stalin would be proud.
