The family of a 10-year-old girl who received an MP3 video player for Christmas was shocked when it found the player was loaded with explicit songs and pornographic movie clips.
Cookeville resident Daryl Hill said his daughter was thrilled to find that Santa had left an MP3 player under the tree -- until she turned it on.
"Within 10 minutes, my daughter was crying," Hill told Nashville, Tenn., TV station WSMV.
There were video clips of XXX-rated sex scenes and the pornography on the player.
"I wish I could take the thoughts and images out of her head," said Hill.
The Hills had bought three MP3 players for their children that came from a Wal-Mart store in Sparta, Tenn. It turns out one of the MP3 players had been returned to the store from a previous owner who loaded sex clips, graphic war scenes and lyrics about using drugs.
The Hills want to know why Wal-Mart would sell used merchandise as new in the first place, which is in violation of its own policies.
"If they want to be a major retailer, they need to act like it," said Hill.
The manager at the Sparta Wal-Mart declined comment on the matter and referred WSMV to Wal-Mart's corporate office.
A Wal-Mart representative e-mailed WSMV confirming that stores are not supposed to return opened packages to the sales floor. They said they are working to get to the bottom of the problem.
The Hills said they have declined Wal-Mart's offer to replace the MP3 player. They've already bought their daughter a new one and are hanging onto the controversial one until they talk to a lawyer.
Sounds like a Union plant was busy before Christmas.
Making a mountain out of a molehill and then calling a lawyer.
I believe that these people are happy this happened.
What do you expect from a $7/hour employee being yelled at by his manager to get his work done without overtime.
Yea, bunch a pikers. lol

This wasn’t an “accident.” There must be a deliberate process in place to return items to store shelves...reassigning a SKU number, inventory restock, etc. Walmart just got caught with it’s pants down.
Litigation Lotto Jackpot!
Sounds like a potential mall shooter in the making.
Yeah it’s great when you think you’re buying a new product and it ends up being a return item.
The lawyer might overkill but a call to the BBB might be a good idea.
This doesn’t pass the smell test. This child figures out on her own how to operate the MP3 player, goes to the video menu, opens a clip, watches porn for 10 seconds, and then is devastated. Nope. This is a scam from the get-go.
I thought those kind cost extra.
Bonus!
In my experience the BBB is nothing but an agency that promotes you as good if you pay them. Many moons ago my ex-husband’s family had a business, construction related and we wanted to make sure we were listed with the BBB. All they really wanted was an annual fee, bottom line.

Thats how they keep costs down.
I don’t know how lawyers even interview these people without pointing their finger at them and bursting into loud laughter
It’s an iPOD, not the Space Shuttle.

You don’t have kids do you? My 10 year old can figure these out faster than I can. Fortunately he’s never had one of these extra special MP3 players.
This is one of those occasions where there should be something more than just giving them another player. I would be steaming mad if it had happened to my daughter. If any of you on here wouldn’t be it is because you never had kids. There should be some kind of public and private apology and some kind of restitution offered, plus the employee fired or the supervisor fired if the employee pressured him to return the merchandise to sell as new. And if it is Wal-Mart’s policy to do such they should have their britches burned!
