Should Alimony Die a Quick Death?

"...in today’s world, in which women have fought for the right to equality, alimony seems more like a kid getting an allowance from daddy and I believe it should be abolished altogether except for extremely dire circumstances where a spouse is older, cannot work at all, and for only a short term period. No man or woman should be held to being a slave to an ex-spouse after a marriage ends. That said, if we are going to have alimony laws, I believe that men and women should be held to an equal standard under the law."

My nephew is being bled to death by his ex wife who was cheating on him. The poor son of a gun is barely making it financially. Anytime he gets an increase in income, she’s in court asking for more and gets it! Pathetic!

Nice - you have no knowledge of the circumstances, and you think she’s the problem.

It’s comments like yours that will never help find solutions to thorny problems.

as a matter of fact, my relative are 100% innocent...my brothers ex wife has been certifed by the court as insane, yet they keep letting her file cases against my brother ( his divorce has been going on for 12 years now ) my brother in law’s ex lied about her inability to work, and has taken everything, including his clothes, and gets alimony, the house,car, and everything else. I fault him for not fighting, but he still loved her, even though she was seeing someone else...even my wife says 90% of all divorces are the womans fault, and after a 50-50 split of the assets, neither one should get anything....and that is what I agree with, split it 50-50, then go the hell away......

Which state was she certified insane in? In which court? Does she qualify for SSI? Who takes care of her affairs? How did she "lie" about not being able to work? If she is insane as you claim, she would not be able to work, would she?

and that is what I agree with, split it 50-50, then go the hell away...

Odd.. that wasn't at all what you said just a bit ago. What you were saying then was: depends on who initiates the divorce....if the woman wants out of the marriage, then get out and make it on your own

That is far, far different than 50-50. Which is it?

I've never heard of a paternity waiver, but I have heard of legal cases where two parties had a contract that said the man wasn't responsible for child support, and wasn't involved in the child's life. Later on the woman has come back around asking for child support and the courts award it. They use the justification that support is the child's and that the parents are not allowed to contract its non-existence, therefore it is null.

There's a recent legal case where a lesbian couple used donor sperm (a friend of the couple) and they told him he was free and clear. Once the child was 18 they sued for back child support (once it was "safe" that they couldn't lose custody!)

I believe there is a place for alimony, but that it should not be never ending and it should be matched with requirements on the part of the spouse receiving. (ie, a portion of the funds must be used for education so that one can support themselves!)

It's funny. I think it ties into the supernatural reality of marriage. The bond is not ruptured or attacked by death the way it is by abandonment. A widow has moral authority over her children that a divorced woman does not, because her solidarity with her husband has not been repudiated. It is just being administered at a higher level.

I have read recollections by men who had lost their fathers to death, sometimes without ever meeting them. Admonitions from their mothers to the effect of, "Your father would not approve of that" had a powerful influence on their behavior. They described their mothers' invoking of their fathers' authority as having been critical to keeping them in line, even though their mothers were alone, working much of the time, and carrying on with some difficulty. I believe statistics bear these anecdotes out, and show very different effects on children between divorce and involuntary death of a parent.

Interesting point. I never thought about it that way.

I have to confess that I used the “if you don’t behave you might be forced by the courts to go live with your father” line once or twice. Talk about putting the fear of God into the kid - I only did that a few times before it became unnecessary. She had visited in their house overnight twice, and that was enough to know she did not want to be there full time.

so you are saying the only fincancial obligation a man has is for 1/2 of the cost of an abortion if the woman takes the child to term...

(of course 1/2 the cost of an abortion also includes giving up 100% of all paternal rights and perogatives)

Any woman who gets married without skills/job/education and thinks she can just be pregnant and siphon off the mans salary the rest of her life......deserves to be poor.
