DURHAM -- In a filing Tuesday in Federal Court, unindicted Duke Lacrosse players are suing Duke University, the City of Durham, Duke University professors, Mike Nifong and the DNA lab involved in the case.

The suit also names doctors and nurses who treated the alleged victim the night she claimed she'd been raped at a party. The players are also suing City Manager Patrick Baker and former Durham Police Chief Stephen Chalmers. As part of the investigation, the unindicted players had to give up DNA samples and were named in the school paper.

In the 404-page lawsuit, the players say that Duke University, the City of Durham and the other defendants were part of a "conspiracy to railroad 47 Duke University students" based on "the transparently false claim of rape, sexual offense, and kidnapping made by a clinically unreliable accuser." Also in the lawsuit, the players say that the accuser's claim was "taken virtually from her lips and fashioned into a weapon in the hands of those who would leverage outrage."

“No, their tenure does not protect them from slander and the court system. If they are found guilty, this can be used for dismissal from their job.”

Hyperbolic lampoon of the tenure system.
Thought that was clear.

I’m nearly ANTI-litigious.

But with cases like the smear on the Duke lacrosse organization...
I’m in sympathy with a “sue the B@ST@RD$” attitude.

Thanks, abb. I read it when LB posted it on breaking news. I hope this can get some traction, as it sounds as though there are quite enough scoundrels to go around in this case. I also hope the media covers it in spades, as they certainly threw enough dirt on the kids when the allegations were made.

I won’t stop watching. Thanks again. BTW, hello to all of you and have a very, VERY Merry Christmas. xxoo’s CG

Its a curious thing...the university got the accused guys to sign a document....which meant they got “paid” off by the university for whatever was done...and they couldn’t sue the university or its staff. I thought the coach also got paid off in some fashion...so he couldn’t sue anyone. I kept thinking the rest of the team were taken care of...obviously....they weren’t. I’m guessing they have a smart team of lawyers...and expect to clean out the bank completely. The accused guys are suing the city currently...and expect well over $30 million for their pains. And I’m thinking these guys are expecting much more...with a combined gain of $50 million by the end.

The gang of 88? They might want to think about leaving the US and hiding out in Panama.

It’s more a matter of getting certain people under oath and forcing them to admit what they die.

Sovereign immunity with respect to the state, among other defenses

Duke University is not affiliated with the state.

Tawana Brawley now goes by the name Maryam Muhammad.

Her story is amazing.

She and her mother raised about $500,000 in a legal defense fund for her in the event that she was prosecuted for lying to the police.

She and her mother were subpoenaed by the grand jury and rather than show up, they skipped town and moved to Virginia - but not before they cleaned out the defense fund bank account.

were the 81 faculty signers of the open letter sued, too ? I’m all in favor of suing the perp, too .. she should never realize a dime from a book or any other media source for what she did to these young men. Even if she doesn’t have a dime to her name now, they would hold a judgment against her for years until the point where no one would want her story (assuming anyone wants it now).

Individual state officers are not immune from liability for acts which violate a civil right protected by federal law.

I had dinner a couple of months ago with one of the Duke Lax players and he told me that Duke President Broadhead held a meeting with the team after the acquittals. The player said that the only regret he expressed to the team was that he had not made it clear to Duke athletes how bad an incident like the team party might be to the school’s image, in other words, the whole thing was still their fault. My young friend said the the entire team felt nothing but contempt and disgust for the little coward.

"It will set a great precedent for other unindicted, totally innocent persons like Hillary Clinton who have been falsely accused of crimes and called vicious names by R party activists."

Indeed! I was outraged when Hillary was dismissed from the White House, arrested, handcuffed, fingerprinted and jailed with a bail of 4 million dollars. And then, despite all the evidence showing she had no involvement in anything at all, the prosecution continued.

It will depend upon the racial makeup of the jury.

“certain medical personnel at Duke hospital put out information early on that she had “signs, symptoms and injuries consistent with being raped and sexually assaulted”

The only signs she had was that she had more sperm in her than most sperm banks.
