MIAMI -- Attorneys for convicted terrorism conspirator Jose Padilla say he was so badly mistreated by the government during 3 1/2 years in military custody that he deserves far less than the life prison sentence sought by federal prosecutors. A sentencing hearing set to begin this week for Padilla was postponed Tuesday until Jan. 7 because of a death in the judge's family...
In court filings, attorneys for Padilla also say U.S. District Judge Marcia G. Cooke should look at whether the U.S. citizen would be more harshly punished than other terrorism suspects, and should take into consideration the conditions they described as harsh at a maximum-security federal prison in Florence, Colo.
Federal prosecutors say that life behind bars is the proper sentence for Padilla, 37, and his foreign-born co-defendants, Adham Amin Hassoun and Kifah Wael Jayyousi, were convicted Aug. 16 of conspiracy to murder, kidnap and maim people overseas. Padilla was held in isolation at a Navy brig in Charleston, S.C., after President Bush declared him an enemy combatant in June 2002, a month after his arrest at Chicago's O'Hare International Airport. Pentagon and Justice Department officials have repeatedly and forcefully denied that Padilla was tortured or mistreated at the brig.

The indictment avoids a Supreme Court showdown. Padilla’s lawyers had asked justices to review his case last month, and the Bush administration was facing a deadline next Monday for filing its legal arguments.
“They’re avoiding what the Supreme Court would say about American citizens. That’s an issue the administration did not want to face,” said Scott Silliman, a Duke University law professor who specializes in national security. “There’s no way that the Supreme Court would have ducked this issue.”
The Bush administration has said Padilla, a former Chicago gang member, sought to blow up hotels and apartment buildings in the United States and planned an attack with a “dirty bomb” radiological device.
Padilla was arrested at Chicago’s O’Hare International Airport in 2002 after returning from Pakistan. The federal government has said he was trained in weapons and explosives by members of al-Qaida.
Although the Justice Department has said that Padilla was readying attacks in the United States, the charges against him and four others allege they were part of a conspiracy to murder, kidnap and maim persons in a foreign country and provide material support to terrorists abroad.

Jose Padilla, alias Abdullah al-Muhajir and Ibrahim Padilla, was born in 1971 in Brooklyn, New York to parents of Puerto Rican descent. After moving to Chicago, Illinois, Padilla joined a gang and was arrested numerous times. Other aliases used while a gang member include Jose Rivera, Jose Alicea, Jose Hernandez, and Jose Ortiz. Padilla was arrested at age 14 for a gang-related robbery and murder. In May, 1988, Padilla turned 18 and was release from juvenile detention in Chicago on probation until age 21. After his release, Padilla moved to southern Florida. In 1991, he was arrested after a road rage incident during which he pointed a gun at a police officer. He served 10 months for the crime.
