Horn has a problem though, if the article reported his converation with the police dispatcher right. He left his home after saying the words : " I'm gonna kill 'em." That shows intent to kill, not to defend a neigbor's property.
If he had said, "I am keeping them out of our yard," then he would be a lot better off. I beleive that unfortunately the Grand Jury will return an indictment for homocide. It will be a jury trial where he likley will be exonerated, if he has a sharp trial lawyer who knows how to select a jury in the empanelling process.

I heard the whole thing twice a month ago.
He went out to make a citizens arrest, then they came at him on his property, so he shot them.
Had they not been criminals robbing people they would not have been shot.

I already fought that battle on the original thread. He was not very smart (Joe Horn), and I am not sure what he did was right; Yet, according to Texas Law, regardless of what he said, what he did was lawful and legal.

That shows intent to kill, not to defend a neigbor's property. In the event, neighbors corroborate his version of events. They were in his yard when he left his house, about 15 feet from him. Then, when he yelled, "Move and you're dead", they moved.. TOWARDS HIM. I suspect the forensics also corroborate, or Mr. Horn would be in jail.

I beleive that unfortunately the Grand Jury will return an indictment for homocide Texas grand juries are not known for bringing a "true bill" when persons committing crimes are shot by law abiding citizens. I predict a "No Bill". That means they will refuse to indict him.
But if they do, I'll gladly contribute to his defense fund.

It’s accurate. I heard the 911 call played up here in Oklahoma, and that is what he said. Methinks he’s going to trial.
