Evidence against former astronaut tossed

A judge agreed Friday to toss much of the evidence against Nowak, a former astronaut accused of making a diaper-assisted, 1,000-mile drive to confront a woman vying for the affections of the same space shuttle pilot. 
Investigators took advantage of 44-year-old Lisa Nowak, who had not slept for more than 24 hours, coercing her into giving information in a lengthy arrest interview, Orange County Circuit Judge Marc L. Lubet said. 
Lubet granted a defense motion to throw out comments she made during the six-hour interview and items seized during a search of her BMW, including maps to alleged victim Colleen Shipman's home, large garbage bags, latex gloves and some soiled toddler-sized diapers.

    The judge made a ruling and tossed out the soiled diaper evidence. To that I would say his ruling stinks....!

 ..."But evidence from a duffel bag Nowak was carrying  a steel mallet, buck knife, BB gun resembling a real 9mm handgun, gloves and six feet of rubber tubing  remains in the case."

    More so, she is military and will face UCMJ justice.
 Nowak is at risk of court-martial for conduct unbecoming an officer and a gentleman and adultery, due to her marital infidelity and perhaps attempted murder.

 I said this a couple of months ago, and I will say it again: This woman is not going to get a day of jail time. Her attorney will make her look sympathetic, besides, there was no actual 'kidnapping', as most people think of it. The victim got nailed with pepper spray, and for just about anyone with a clean record, there's a strong chance of mere probation anyway, especially if the perpetrator is female.
 But her attorney will pull out the 'astronaut hero' card, and further point out that for the rest of her life, she will have to suffer the label 'diaper astronaut', with all the attendant humiliation. He will argue that she's already suffered enough, given the public flogging, and being drummed out of the astronaut corps with its first 'dishonorable discharge'.
 Not one day in jail. Mark my words.
