CNN: Flying Mexican Flag Over US Flag Is OK
NewsBusters.org ^ | Richard Newcomb

A Mexican bar owner in Reno Nevada flew the Mexican flag above that of the United States. Only problem is that this is specifically illegal under United States Code Section 7, Title Four, which states,

(c) No other flag or pennant should be placed above or, if on the same level, to the right of the flag of the United States of America, except during church services conducted by naval chaplains at sea, when the church pennant may be flown above the flag during church services for the personnel of the Navy. No person shall display the flag of the United Nations or any other national or international flag equal, above, or in a position of superior prominence or honor to, or in place of, the flag of the United States at any place within the United States or any Territory or possession thereof: Provided, That nothing in this section shall make unlawful the continuance of the practice heretofore followed of displaying the flag of the United Nations in a position of superior prominence or honor, and other national flags in positions of equal prominence or honor, with that of the flag of the United States at the headquarters of the United Nations.

The brazen effrontery of the bar prompted an American veteran to cut down both flags. But when CNN reported on the event, they managed to significantly skew the perception. The CNN report simply states that the veteran was angry that the Mexican flag was placed above that of the US- no mention was made that it was in fact illegal under US law. CNN compounded their offense by showing in their video clip, not the actual words of the relevant US code that outlaws this action, but instead 'flag rules' taken from USHistory.org, thus downplaying the actual offense, by suggesting that athe law is in fact merely recommended behavior. As in so much relating to the illegal alien lobby, apprently it is OK with CNN for immigrants to disrespect and/or disobey the laws of our country, but let one American try to react, and they scream bloody murder. Balance? What balance? Cross-posted on StoneHeads.

"So presumably if the army of a foreign invader were on our soil, you’d argue we couldn’t do anything about it, due to the Second Amendment?"

Great point. The surrenderists would defend the rights of invaders to bear arms!

...it is not an enforceable law as there are no penalties attached.

Ah... it must be part of the statutes governing immigration.

It’s a damn good start. Completely agree with your tagline.

This is just an instruction to government offices how to display the flag.

You are incorrect. 4 USC sec 5 indicates that the following sections apply to civilians and civilian organizations. Ergo, 4 USC sec 7 applies to civilians.

Displaying the flag contrary to this section of the Code of Federal Regulations is unlawful. Unlawful means wrong and should not be defended whether a penalty is described or not.

A private citizen can do about what he wants on his own property with any flag as far as I’m concerned.

So, are there other laws that private citizens are free to pick and choose whether to follow or not? Are laws even necessary? Why bother at all with the troublesome things?

This is only for Gov't offices?

No.

4 USC sec 5 specifies civilians and civilian organizations.

we shouldn't obey the law if we don't feel like it?

Bad laws should never be obeyed. Not because one does not feel like it, but because obeying it establshes a precedent that the bad law is somehow right or ok.

Military persons are taught that they are not required to obey an unlawful order. Should civilians be allowed less?

No.

Its legal to kill babies in the womb, but is it right?

No?

It's illegal to take down a man's flag, flown on private property -- but is it wrong?

No.

When our Dish system was installed in 2000, the first thing I asked the tech was to show me how to block CNN.

He laughed and said that was a fairly common request for those cancelling the local cable to get Fox News.

CNN remains blocked on our system. When visitors try to get CNN, I tell them when they check in to one of the local motels they can watch CNN. CNN is not allowed to waste air time and electricity at our home.

This is another good reason for conservatives to block CNN on their satellite and cable systems.

There are alot of old vets like yourself, who are reaching the same level of discontent re Mexican Flags and other bs.

The left had better back away from this bs or the scene below will be repeated throughout the US.

Below is a great link re how the Army Vet reacted to the flying of the Mexican flag over the American flag. (Wait about 30 seconds for the commercial to play.)

If said folks declared war and were part of an invading militia, then, duh, we would be fighting them. Flying a foreign flag is NOT an act of war. If this were true, we would have to arrest everyone at the Columbus Day, Dominican Independence Day, and West Indian Day parades.

I don't care for anyone who flys a foreign flag above old glory, but said person has a right to do so, especially if it is on their property.

The link below shows how a Mexican American felt about a Hispanic goon trying to burn an American Flag.

http://youtube.com/watch?v=9fiEa9uB0yA

You two might be really surprised at how Mexican American citizens feel about this bs. I would love for you two to have your lame a$$ discussions with a loyal Mexican American friend of mine.

He served as a Marine in Desert Storm and his two nephews are on their 3rd tour of Iraq. He has zero tolerance for b$ artists like you two and the ACLU b$ which is the same line. One flag flies over his business and on his trucks, the American Flag.

Like the Sarge requested, don’t respond to me. I avoid contact with critters like you and other vermin who spout the ACLU spin.

This flag bs of Mexican flags flying over or instead of our flag is reaching a critical issue with millions of vets. A lot of those vets are Mexican Americans with maybe less tolerance for this Mexican Flag bs than the rest of us.

The dumping of the tea in the Boston Harbor was a symbolic event that eventually lead to this country’s freedom.

This vet’s response will be replicated across the country, and maybe looked at by historians in the same light of the Boston Tea Party.

It’s too bad they have to be the ones to do it. The country they protected should be doing it for them.

All I can say it’s about time we stop sitting on our hands. I just sent the link to as many people as I could...
