NEW ORLEANS -- A federal appeals court has rejected a second appeal from the New Orleans district attorney over a ruling that said he violated the civil rights of dozens of white employees when he fired them and replaced them with black workers after taking office in 2003.
The 5th U.S. Circuit Court of Appeals turned aside a request by Orleans Parish prosecutor Eddie Jordan to have the full court review the case.
Earlier, a three-judge panel of the 5th Circuit upheld the verdict against Jordan, that, with interest, means Jordan's office owes the ex-workers and their attorneys about $3.5 million.
In 2005, a jury rejected Jordan's contention that he filled key positions with political supporters and did not discriminate based on race when he took over from longtime District Attorney Harry Connick Sr. in 2003.
In his appeal, Jordan had argued that jurors did not have enough evidence to reach that conclusion.
Plaintiff attorney Clement Donelon said that Jordan's only remaining option is to ask the U.S. Supreme Court to review the case. Because of the latest ruling, Donelon says a stay on collecting the verdict will expire Sept. 26.
Donelon said that he is prepared to seize assets of the district attorney's office, including its payroll account. Donelon said the office does not have insurance to pay the verdict. Jordan is not personally responsible for payment.

NEw Jersey, but were trying hard to catch up. They had the Soprano’s what do we get...an awful Cop show so it will take us a while. Don’t give up on us the next elections can still be screwed up.

New Jersey by a vast margin. Higher Taxes in NJ and it is one of the most anti-gun states in the US.
At least there are other parts and other cities to Louisiana, some of which are nice and have good food and people.
Plus, there are drive thru daiquiri’s everywhere.

This is actually one of the more curious aspects of the case. The plaintiffs alleged that Jordan acted outside of the course and scope of his employment by firing the white employees and replacing them uniformly with blacks. The jury found that although, Jordan discriminated against the white employees, he was not acting outside the course and scope of his employment. Thus he is not personally liable for the jury verdict.
I found this odd because Jordan's drop is to prosecute criminals in Orleans Parish, not to systemtically replace white employees with black ones.
As practical matter, the money now has to come from the Parish DA's office treasury, which is pretty much underfunded anyhow and now makes it more difficult for Jordan to actually do his job. Not that he has done a great job of it, regardless.
He can fire and hire anyone he wants. He just can’t do it for race. In this case, he was paying back political supporters. Which is practically a religion in Louisiana.

Thanks for the update. I heard the treasury was just about empty too. Fees from collecting child support was helping the treasury at one time under Harry Connick Sr. Connick was not the most brilliant DA, but Jordan has just been horrible. Jordan has the crimminal vote for sure. I hope the City makes a real rebound.
