No Charges After Toddler Died In Car

No charges will be filed against a middle school administrator whose toddler daughter died last month when she was left in the back seat of her mother's SUV during a heat wave, a prosecutor said Tuesday.

Leaving the child in the car for the work day was "a substantial lapse of due care" but did not meet the definition of reckless conduct necessary for prosecution, said Clermont County Prosecutor Don White.

Brenda Nesselroad-Slaby, 40, is assistant principal at Glen Este Middle School, about 20 miles east of Cincinnati. Authorities said she left her 2-year-old daughter, Cecilia, strapped into a car seat for about eight hours on Aug. 23 while she was at work at the school.

Temperatures outside reached about 100 degrees.

I’ve read the op.
I’ve also read she visited her car 5 times.She evev moved it.
How does she explain that?

A dying child will urinate, defecate, and vomit.
At 2 yrs. they are facing forward.

Even if the child was silent, you would have thought there would have been a smell.

Honestly, Proud, when a child is injured and killed in this fashion it brings out the worst in people. Again - there’s ONE police report in which it was recorded that others had described I believe it was at most 3 instances where this woman left her child/children in the car for periods UP TO 10 to 15 minutes. We have no indication that she has ever done something like this before beyond a 10 to 15 minute window. And frankly I’m not going to indict the woman based upon that kind of testimony.

We have to believe the worst about this woman at every level to indict her and I just don’t think the article (despite how it and others are written) demonstrate anything other than this was a horrible accident. She does not deserve to go to jail and I can’t jump to the conclusion that she did this intentionally. Not based upon what i’ve read and what I’ve seen.

As for your last question - sorry - it’s a strawman argument. I would neither leave my kids in her care nor yours - what does that say about you?

A lapse in memory is forgetting to take the child out of the car. Horrific parenting, and something that afflicts way too many of us in “modern” society is no one knowing where the child is for 8 hours. And not bothering to check. Tell me please how this is an OKAY thing.

Daycare has allowed parents to completely abdicate their responsibilities and this is one of the many results.

Interesting how for some reason (not explained; it’s just there) they looked at air bags - with the disclaimer that there is no way people should not have air bags or baby seats!

PHOENIX (AP) — A suburban police officer is accused of leaving a police dog in a patrol car for more than 12 hours on a 109-degree day, killing the animal.

Chandler police Sgt. Tom Lovejoy was booked into the Maricopa County jail on a misdemeanor charge of animal cruelty after a two-week investigation into the death of a 5-year-old Belgian Malinois named Bandit. He was released later Wednesday, said Capt. Paul Chagolla, a spokesman for the Maricopa County Sheriff’s Office.

The sheriff’s investigation showed Bandit was in Lovejoy’s patrol car from about 9 a.m. to shortly after 10 p.m. Aug. 11. During that time, the investigation found, the officer ran errands, napped and ate out with his wife. Lovejoy later found the dog dead in the car.

“I am certain Sgt. Lovejoy has suffered greatly from leaving his police dog in a sweltering car,” Sheriff Joe Arpaio said in a statement. “I do not relish the idea of compounding his sadness. However, Lovejoy must be treated like anyone else in similar circumstances.”

Lovejoy said Wednesday night that he is scheduled to appear in court Sept. 25 and that his lawyer advised him not to comment further.

“With the sheriff railing on me right now, it’s kind of hard to say anything,” Lovejoy said.

This thread is amazing. Should a person who answers a telephone while they're bathing a baby be prosecuted when the baby drowns, be held liable? - Yes.

Should a person who runs over a child crossing the street, because they are talking on their cell phones be prosecuted? - Yes.

So why wouldn't someone who commits a whoopsie-daisy by cooking their kid in a car be held liable???

I know many public school employees.
I don’t know any who would visit their car five times during work hours.
Or move their car to another part of the lot after they had already parked it.

Very sad, but give the woman a break.

I have more sympathy for the 2 yr old child that was cooked to death.

I am a mother.

I think about my kids SEVERAL times in a day while at work...

this woman KILLED another human being. If she had cooked someone else's child she'd be doing serious time.

yeah-- just give her a break and teach other parents out there, exactly how they can murder their child and get away with it....heck-- if she had done this to her DOG she would get tougher treatment.....play maybe all you like. you don't FORGET your child ALL DAY!

and if you do-- you need not to ever be around children.
