Today was an eventful day. I drove to Cleveland, reunited with my father’s side of the family and got arrested. More on that arrested part to come.
For the labor day weekend my father decided to host a small family reunion. My sister flew in from California and I drove in from Pittsburgh to visit my father, his wife and my little brother and sister. Shortly after arriving we packed the whole family into my father’s Buick and headed off to the grocery store to buy some ingredients to make monkeybread. (It’s my little sister’s birthday today and that was her cute/bizare birthday request.)
Next to the grocery store was a Circuit City. (The Brooklyn, Ohio Circuit City to be exact.) Having forgotten that it was my sister’s birthday I decided to run in and buy her a last minute gift. I settled on Disney’s “Cars” game for the Nintendo Wii. I also needed to purchase a Power Squid surge protector which I paid for separately with my business credit card. As I headed towards the exit doors I passed a gentleman whose name I would later learn is Santura. As I began to walk towards the doors Santura said, “Sir, I need to examine your receipt.” I responded by continuing to walk past him while saying, “No thank you.”
As I walked through the double doors I heard Santura yelling for his manager behind me. My father and the family had the Buick pulled up waiting for me outside the doors to Circuit City. I opened the door and got into the back seat while Santura and his manager, whose name I have since learned is Joe Atha, came running up to the vehicle.

I remember that case, but I don't remember the specifics. I do remember he had been driving a car just before, or had been in the driver's seat or something. In any case, as mentioned, Ohio state law specifically states he doesn't have to show it. The law in the precedent was probably different.
Walmart and Best Buy check your receipt at the door; you know that going in.

He was “arrested” as soon as the store stopped him from leaving. Not only was he arrested but so was his father when they stopped him from leaving and blocked his car. He might have a good false arrest claim against the store. That said the guy is a jerk.

I do have a problem with this. If they think I am shoplifting, let them charge me. If you are a member of Sam’s or Costco or other similar membership shopping clubs, you have given them the right to check your cart against your receipt. Otherwise, no.
Sue Circuit City, the perps who were the two employees involved, the cop and the city of Brocklyn, Ohio for false arrest.
I think we need to separate the issues here.
A lot of people don’t like being searched, but we all seem to agree that the answer is just to not shop there — certainly don’t shop there and then complain. May I suggest the small privately-owned stores where you never get searched if you walk from the cash register out the door. You generally get better service at such places anyway.
The issues here to me are: “Papers, please,” false arrest and unlawful detainment. Even the rights of a jackass can be violated.

2905.03 Unlawful restraint.They employees were clearly guilty of this crime for not allowing him to leave the parking lot. Plus they unlawfully restrained his father and siblings. They should have been arrested. The jackass in question was guilty of no crime, but was arrested. As the manager I wouldn't let him back in the store though.(A) No person, without privilege to do so, shall knowingly restrain another of his liberty.
(B) Whoever violates this section is guilty of unlawful restraint, a misdemeanor of the third degree.

There’s an old cop saying when dealing with jerks like this, - “You may beat the rap but you won’t beat the ride”. It means that if you are going to be an ass the cop can seriously screw up your night. Even if he can’t make a charge stick, you still lose.
When Best Buy asked my friend for his receipt,

When they asked to look in my brother’s bag at WalMart,

When Circuit City asked ME for my receipt,
I got the ACLU to help me sue them.

I live in Ohio and have been in that CC store a number of times. They do the receipt checking at Home Depot all the time. The guy who marks the receipt often is standing right there watching the whole transaction. This means they don't trust their cashiers.
Sometimes the checker is not at the register but they never look in the bag. I have had my receipt marked a number of times but I have rarely if ever had anyone actually look in my bag. They just want to mark the receipt.
At BJs they make the appearance of checking the 125 items in my two shopping carts full, but it is just a show.
You can’t with Walmart either.
The police on the scene already charged this idiot instead, hopefully a charge for improperly paging 911will be tacked on as well.

If this a-hole prefers to shop where his package will not be checked against proof of purchase, he is free to go elswhere. The rest of us don’t mind helping in the war against shoplifting. A pox on him.
