Court: Mexican trucks program to proceed (9th Circus says 'Let 'em roll!')

SAN FRANCISCO - The Bush administration can go ahead with a pilot program to allow as many as 100 Mexican trucking companies to freely haul their cargo anywhere within the U.S. for the next year, a federal appeals court ruled Friday.

The 9th U.S. Circuit Court of Appeals denied a request made by the Teamsters union, the Sierra Club and the nonprofit Public Citizen to halt the program.

The appeals court ruled the groups have not satisfied the legal requirements to immediately stop what the government is calling a "demonstration project," but can continue to argue their case.

The trucking program is scheduled to begin Thursday.

In court papers filed earlier this week, the Teamsters and Sierra Club argued there won't be enough oversight of the drivers coming into the U.S. from Mexico.

They also argued that public safety would be endangered in a hasty attempt by the government to comply with parts of the North American Free Trade Agreement.

The trade agreement requires that all roads in the United States, Mexico and Canada to be opened to carriers from all three countries.

Canadian trucking companies have full access to U.S. roads, but Mexican trucks can only travel about 20 miles inside the country at certain border crossings such as ones in San Diego and El Paso, Texas.

Next step for the Teamsters....fight to unionize them. They’re fooling no one....that’s really their beef now anyway. Once the Mexican drivers are unionized, Teamsters will be defending these drivers every stinking move.

I wonder if accidents all over the country would eventually be used as justification (and supported by the American people) for the need for expediting the Corridor?

The campaign poster was blatant in its xenophobic symbolism: Three white sheep kicking out a black sheep over a caption that read “for more security.” The message was not from a fringe force in Switzerland’s political scene but from its largest party.

The nationalist Swiss People’s Party is proposing a deportation policy that anti-racism campaigners say evokes Nazi-era practices. Under the plan, entire families would be expelled if their children are convicted of a violent crime, drug offenses or benefits fraud.

The party is trying to collect the 100,000 signatures needed to force a referendum on the issue. If approved in a referendum, the law would be the only one of its kind in Europe.

“We believe that parents are responsible for bringing up their children. If they can’t do it properly, they will have to bear the consequences,” Ueli Maurer, president of the People’s Party, told The Associated Press.

Ronnie Bernheim of the Swiss Foundation against Racism and Anti-Semitism said the proposal was similar to the Nazi practice of “Sippenhaft” - or kin liability - whereby relatives of criminals were held responsible for his or her crimes and punished equally.

Similar practices occurred during Stalin’s purges in the early days of the Soviet Union and the 1966-76 Cultural Revolution in China, when millions were persecuted for their alleged ideological failings.

“As soon as the first 10 families and their children have been expelled from the country, then things will get better at a stroke,” said Maurer, whose party controls the Justice Ministry and shares power in an unwieldy coalition that includes all major parties.

He explained that his party has long campaigned to make deportation compulsory for convicted immigrants rather than an optional and rarely applied punishment.

The party claims foreigners - who make up about 20 percent of the population - are four times more likely to commit crimes than Swiss nationals.

Bernheim said the vast majority of Switzerland’s immigrants are law-abiding and warned against generalizations.

“If you don’t treat a complicated issue with the necessary nuance and care, then you won’t do it justice,” he said.

Commentators have expressed horror over the symbolism used by the People’s Party to make its point.

“This way of thinking shows an obvious blood-and-soil mentality,” read one editorial in the Zurich daily Tages-Anzeiger, calling for a broader public reaction against the campaign.

So far, however, there has been little popular backlash against the posters.

“We haven’t had any complaints,” said Maurer.

The city of Geneva - home to Switzerland’s humanitarian traditions as well as the European headquarters of the United Nations and the U.N. Refugee Agency, or UNHCR - said the campaign was likely to stir up intolerance.

The UNHCR said the law would run contrary to the U.N. refugee convention, of which Switzerland is a signatory.

But observers say the People’s Party’s hardline stance on immigration could help it in the Oct. 21 national elections. In 2004, the party successfully campaigned for tighter immigration laws using the image of black hands reaching into a pot filled with Swiss passports.

“It’s certainly no coincidence that the People’s Party launched this initiative before the elections,” said Oliver Geden, a political scientist at the Berlin Institute for International and Security Affairs.

He said provocative campaigns such as this had worked well for the party in the past.

“The symbol of the black sheep was clearly intended to have a double meaning. On the one hand there’s the familiar idea of the black sheep, but a lot of voters are also going to associate it with the notion of dark-skinned drug dealers,” said Geden.

The party also has put forward a proposal to ban the building of minaret towers alongside mosques. And one of its leading figures, Justice Minister Christoph Blocher, said he wants to soften anti-racism laws because they prevent freedom of speech.

It would be similar to allowing any third world nation pilot to fly his own plane into the US and land at our airports without a flight plan or inspection of their aircraft.

Would many land successfully? Probably.

Would it be consistent with the cost other airlines have to pay to comply with traffic control procedures? No.

Who would ultimately bear the cost of their intrusion into that market? The US taxpayer and those companies already in that business.

The difference is staggering for the logistical support of our nation. It is foolish.

I have a real life experiance here in minnesota to relate..
I manage some appts. here 7 small buildings..

Mexican drunk at 6am..trys to force his way into a ground floor appt....the pregnat 19yr. old white girl who lives there forces the door closed and locks it.He goes arround the front,,kicks in both double paine widows and as he is crawling inside the police show up and drag him back out...glass and blood everywhere...The police say they will charge him with,assault,attempted rape,B.E. and public intox.....As I am fixing the windows 4hrs. later ...he walks past me to his appt....HE NEVER EVEN WENT TO JAIL,OR DETOX....they sewed up his arm and RELEASED him...NOW if that was me or any of my friends..they would be INCARCERATED of several months..and after huge monitary expenditure,,,MAYBE released to the work house....
Incredulas? This is a true story
I complained...the building owner complained...the poor pregnant (9mo)girl complained....NOTHING HAPPENED the administrative police I talked with said””it cant be proved he did anything wrong” Those where her words.
So after much complaining..The police tell us to lie,,,to bump up the cost of windows so they can charge with criminal damage to prop.They tell us we need to BREAK the LAW to get charges on this guy,,,when they allreaddy have “or allreaddy would have if the perp was white”
B.E.,endangerment,attempted rape,public intox.
Right..I think they wanted a lever to shut us up.
Apparently the girl involved was shut up somehow.But in this county normally the state and social services would go ahead and stomp on the guy anyway without cooperation of the victom....if he was white.
So if you are mex..you can get by I guess at least here in
Rochester minnesota.

Something else occured to me;;’;;

Last week a drugged black man 50 yrs old. fell down in the parking lot,full services were called response of maybe 2 min.fire truck,ambulance,3 squads...total cost must be arround 8k...because one old black guy was drunk/drugged or both,Now I work 50hrs. a week ,I cant afford a ambulace ride,we all drive each other if someone gets hurt,”$500 for an ambulance” a kid had a 6 inch cut across the top of his head several months ago and we DROVE him to the hosp.
So tell me how long can this go on?
The people who WORK and pay the BILLS cant afford to ride ,
But the DRUNK A-hol rides for free? WTF?
I dont know ...
Looks like the responsable are punished...the honest are punnished ,the hedonistic are rewarded,the 3rd world animal like behaviors are SUPPORTED by law.

Why we are trying to "equalize" ourselves with a third world, corrupt, despotic, preying, criminally disfunctional neighbor like Mexico is beyond me.

This is a one way street. Any American trucker who owns his rig and crosses the border and tries to haul loads in Mexico is crazy.

There must be some mighty big bribes going into the pockets of our politicians.

As an OTR trucker, I assure you, that any Mexican truck that pulls into a scale in any state that does not conform to that state’s DOT regulations, he/she will be paying some hefty penalties and may be shut down or impounded

Mexicans are not held accountable for other laws. I will not be surprised if they're given a break at the scale as well. They are the exception. They must not be discriminated against.

Sadly, we live in a much different world today, post-nuke, where it takes more than a slap in our face to get our full and complete attention.

The risk of doing little to discourage and then actually encourage it under the guise of opening up trade and commerce even more between adjacent nations and effectively build a NA community carries a potential cost that some seem to be willing to pay and doesn't cause many others to bat an eye.. Does saying that mean I'm anti-business or anti-capitalist? No, quite contraire, reality bites, sometimes at the most inopportune time.

We live in interesting troubling times.

Not that anyone wants to be oblitered or anything but if I were near there, I’d get more insurance. Are these trucks going everywhere or just on one stretch of highway? I wonder how many terrorists already have Mexican names and commercial drivers’ licenses? I hope we don’t find out the hard way.

If American truckers were serious, they would send some BigRigs down to form a blockade on the border entrances. I suspect that might draw some attention to their and our plight..

The House has already voted against this crap and the President has taken time out of his vacation to push this thing through the courts.....never letting the Senate have a chance at it.

I am in Texas. Odds are we will, right here, not very far in the future. I figure it will be in Dallas as the sooner they use a weapon after crossing the mexican border the less chance they will have of it being discovered. Houston and San Antonio have too many of their "comrades" but parts of Dallas are ripe terror target.
