(Federal) Judge Strikes Down Hazleton's Illegal Immigrant Law

ALLENTOWN, Pa. (AP) -- A federal judge on Thursday struck down the city of Hazleton's tough immigration law, which has been emulated by cities around the country. The Illegal Immigration Relief Act sought to impose fines on landlords who rent to illegal immigrants and deny business permits to companies that give them jobs. Another measure would have required tenants to register with City Hall and pay for a rental permit.

It was pushed by Hazleton's Republican mayor last summer after two illegal immigrants were charged in a fatal shooting.

Hispanic groups and illegal immigrants sued in federal court to overturn the measures, saying they usurp the federal government's exclusive power to regulate immigration, deprive residents of their constitutional rights to equal protection and due process, and violate state and federal housing law.

The judge has to know that his will be appealed. No doubt, if the judge is a good judge (and by that I meant a smart judge, be he liberal or not), he will have written a very extensive and solid opinion. It will be interesting to see the analysis in the coming days by some conservative legal minds. Blaming it on a Clinton appointee or highlighting that there is nothing we can do about a particular activist judge will be the knee jerk reaction (regardless if those things are true). There will be solid legal opinion on both sides and the real battle will continue to be in the courts and in the laws that each city will continue to pass. If these laws don’t work then maybe there are other laws that will. As with the Feds, if they simply enforced the existing laws on the books, there would be no need for additional laws.

I hope Lou Dobbs and Glenn Beck raise bloody holy hell about this on their shows tonight. They’ve done more to keep the issues of illegal aliens and border security on the front burner than anyone else in the TV media. Its a shame the folks on Fox seem more concerned with lost celebrities or having Geraldo bloviating his swill.

The “judge” is probably a charter member of the ACLU (Anarchist Communist Lawyers Union).

Hmmmmmmmmmmmm what exactly does sanctuary cities do but

“usurp the federal government’s exclusive power to regulate immigration” when they pass resolutions and ordinances to enable illegal aliens to stay in their cities and have the rights and privileges of REAL immigrants...

“deprive residents of their constitutional rights to equal protection and due process”...American residents have to be citizens to have the same rights that the illegal aliens are just given wholesale...hardly “equal protection and due process”...and illegal aliens do not have COTUS rights...

“violate state and federal housing law” There is no state or federal housing law that states illegal aliens can stay in a building in any city in Amertica...rather there are laws to say that illegal aliens cannot be here in the first place...the violation is the unlawfulness of the illegal aliens original entrance into our country...
