SAN LUIS OBISPO, California, July 6, 2007 (LifeSiteNews.com) - A California woman is filing a complaint in the San Luis Obispo County Superior Court against an organ transplant doctor and the Sierra Vista hospital for willfully deceiving her and murdering her physically handicapped son for the purpose of harvesting his organs.
Mrs. Navarro is the mother and only surviving family of her son Ruben, who was stricken with Adrenal Leukodystrophy, a rare disorder that left him confined to a wheelchair. The court papers allege that last January, 26-year old Ruben was transferred to the Sierra Vista Regional Medical Center due to a medical issue. Ms. Navarro went to visit him at the hospital where she was led to believe that Dr. Hootan Roozrokh was Ruben's "treating doctor". According to the complaint, he was actually working for a California organ-harvesting corporation.
The complaint also states that Roozrokh told Navarro words to the effect that, "There is nothing that can be done for your son. He is going to die." She was also falsely informed that according to hospital policy, the plug on her son's respirator had to be pulled after 5 days. Greatly distressed and having been led to believe that her son had no chance of survival, Ms. Navarro says she agreed to donate his organs. At no point, however, did she consent to the removal of life-support.
The complaint documents describe the following events, saying that Hospital medical staff took Ruben into the operating room where they removed the respirator. He kept breathing, however, and his heart continued to beat. At the direction of his "treating doctor," Ruben was administered a lethal dose of morphine and Ativan. He continued to live, however, and the doctor said (as quoted by witnesses in the complaint), "Let's give him some more candy." After several doses of morphine, the doctors gave up, wheeled him away and left him to die without life support where he died nine hours later.
According to LifeSiteNews.com Medical Advisor Dr. John Shea, the debate about whether to harvest organs usually surrounds a comatose person, a victim of a car-crash for example, who is hovering between life and death. In this case, however, it appears that Ruben was not necessarily going to die.
The question of when a person actually dies and when or if it is ethical to remove their organs is highly debated. As Shea explained, people can be brought back to life even fifteen minutes after their heart has stopped beating. Since the notion of cardiac death was developed in 1993, he said, there has been a significant increase in the number of organs harvested. In fact, the number of "non-beating" heart donations-people who may not have actually died-more than doubled between 2003-2007 in the United States. (see http://www.lifesite.net/ldn/2007/mar/07032104.html)
"If the allegation is true, that they gave lethal doses of morphine three times, I can't see how that can be interpreted in any other way than deliberate homicide," said Dr. Shea about the current case. Kevin D. Chaffi, the California attorney representing Rosa Nevarra, explained to LifeSiteNews.com that the young man didn't have much money, he was disabled, and his mother was also disabled and lived three hours away.
"He's the ideal victim," Chaffi stated. Referring to the organ-harvesting corporation, the lawyer said that while he didn't know what their motivations were specifically, "it was an opportunity for this type of situation to occur." At the same time, he admitted that he had never come across another case like this in California. Chaffi continued, "I think it's a sign that we need more protection for people with disabilities or any potential organ donor and stiffer punishment."
If the allegations are true, this event will have fulfilled the predictions of David Crippen, a University of Pittsburgh critical-care specialist, who stated in the Washington Post in March of this year, "Now that we've established that we're going to take organs from patients who have a prognosis of death but who do not meet the strict definition of death, might we become more interested in taking organs from patients who are not dead at all but who are incapacitated or disabled?" That is just sickning.
Sickening - but is it true? The disease causes destruction of the myelin nerve sheath - wouldn’t transplanted organs have pre-existing nerve damage, and possibly progressive nerve damage after transplant, depending on whether the recipient’s system could supply the transplant with the necessary enzyme?

If true, it’s 1st degree murder.
My wife is a very highly trained, respected, and multi-certified RN of 30 years experience. She had the sticker on her license until about 5 years ago and then one day said she had seen enough “poor” medicine and admin issues in the hospital and took it off.
I know, and her will states she will donate her organs if she is brain and heart dead. But she doesn’t want anyone but her, me, or her survivors to know. Certainly not hospital personnel who may be working to save her life one day.
I agree. Rather unusual name for the Doc as well-considering recent international headlines, I’d be very curious as to his ethnicity. Sounds Iranian, at least...
Ah the greed of money rears its ugly head again.
This is a very good reason not to sign an organ donor card. Doctors who see nothing wrong with abortions (and, astonishingly, some even perform them) cannot be trusted with any life. I always knew it was coming to something like this.
Even if this isn’t true, the fact that it’s believable is sickening.

Lifesite.net? Doesn’t sound like a particularly reliable source, and the story appears to have been hugely exaggerated if not downright fabricated. “But I know it’s true ‘cause I read it on the net.”
But is it true? Always a good question.
I’ve always found the folks at LifeSite to be highly reliable.
Somehow that doesn’t surprise me a bit.

Accuracy in content is given high priority. News and information tips from readers are encouraged. Valid corrections are always welcome.
LifeSiteNews.com emphasizes the social worth of traditional Judeo-Christian principles but is also respectful of all authentic religions and cultures that esteem life, family and universal norms of morality.
LifeSiteNews.com’s writers and founders have come to understand that respect for life and family are endangered by an international conflict. That conflict is between radically opposed views of the worth and dignity of every human life and of family life and community. It has been caused by secularists attempting to eliminate Christian morality and natural law principles which are seen as the primary obstacles to implementing their new world order.
LifeSiteNews.com understands that abortion, euthanasia, cloning, homosexuality and all other moral, life and family issues are part of the international conflict affecting all nations, even at the most local levels. LifeSiteNews attempts to provide its readers with the most useful and up-to-date information on this conflict.
LifeSiteNews.com attempts to dispel confusion and ignorance, enable constructive dialogue and help informed decisions to be made and appropriate actions to be taken for the good of all.
Who Produces LifeSiteNews.com?
The service was originally started by Campaign Life Coalition (CLC), a Canadian national pro-life organization headquartered in Toronto, Canada. Campaign Life Coalition, founded in 1978, was one of the first pro-life organizations to emphasize the international dimension of attacks on life and family. Along with a few other groups it pioneered pro-life lobbying at United Nations conferences. CLC president, Jim Hughes, is currently also vice-president of the International Right to Life Federation.
CLC’s international dimension spurred the development of LifeSiteNews as an international news service. LifeSiteNews.com is now a separate organization, is not involved in direct political action and does not support or oppose political candidates or parties. It is strictly a news and information service.
LifeSiteNews.com is now also supported by a U.S. counterpart organization and is expanding it’s US presence. US citizens have become our largest readership. LifeSiteNews.com networks regularly with leaders and other organizations around the world.

When my best friend’s son was in a tragic car accident with a brain injury from which he would not survive, my friend decided to donate his organs (which were not affected at all by the accident). The doctors told us that unless he was certified brain dead by two independent physicians that could not happen. The action of “pulling the plug” on the respirator did not leave him as a candidate for harvesting as we did not know how long he would survive without help breathing—two hours, two days??? The transplant team must be summoned while the patient is on life support AND brain dead. Tragically (and fortunately) she did not have to make the decision to end life support as he went brain dead a few hours later. At that point the respirator was dialed down and he was kept alive until the transplant doctors from all over the country could be summoned. They all need to be there at the same time to harvest and take the necessary arteries and such as needed to place in the specific recipient.
All this is probably more than most of you wanted to know about the harvesting of organs but it gave the family some solace to know that their beloved son did not live and die for no reason—many others live on because of all that they gave.
This article is so far off base that it should be taken down from FR. A patient with a genetic disease, given high doses of morphine and then harvested??? Doesn’t make any sense.
As I suspected, a purely agenda-driven site purporting to be a news agency. I put about as much stock in it as I do in news direct from NARAL.
I did find the story in newspapers from the area - without the sensationalism and with the OTHER side of the story as well. The lawsuit is real, the woman’s story highly suspicious. But telling the hospital’s side doesn’t do any fundraising for the “Right To Life” organizations, so why bother with it.
