Durham, NC -- On Monday, Duke University leaders announced they have reached a settlement with David Evans, Collin Finnerty and Reade Seligmann. Below are statements about the settlement.
STATEMENT OF THE BOARD OF TRUSTEES AND THE PRESIDENT OF DUKE UNIVERSITY:
This has been an extraordinary year for Duke students David Evans, Collin Finnerty and Reade Seligmann, who were accused of serious crimes they did not commit. In April, after a thorough review, the North Carolina Attorney General declared that they were innocent of all charges and that the charges never should have been brought. We welcomed their exoneration and deeply regret the difficult year they and their families have had to endure. They conducted themselves with great dignity during their long ordeal.
These young men and their families have been the subject of intense scrutiny that has taken a heavy toll. The Board of Trustees and the President have also determined that it is in the best interests of the Duke community to eliminate the possibility of future litigation and move forward. For these reasons, and after considerable deliberation, the trustees have agreed to a settlement with each student. Beyond this statement, the resolution is a private matter among the students, their families and Duke.
This past year has been hard for many people who care about Duke - for students, faculty, staff, alumni, families and friends - and for the three students and their families most of all. We resolve to bring the Duke family together again, and to work to protect others from similar injustices in the criminal justice system in the future.

Or did something already happen in the court of law to ensure this never happens?
I would go after the one or two individuals who organized the 88 — watch the other cowards scamper away and let those organizers twist in the wind.
Nor will there ever be. The settlement is going to be a closely guarded secret.
I suspect this will end all litigation between the three defendants and Duke and the Faculty.

Yes, but you were not one of the ones who were wronged, and who chose to take this settlement with it’s privacy clause.

You have to figure Duke covered the legal fees, and I’m pretty confident each of these three young men just got a check for seven figures.
Now what about the Gang of 88?
The statement appears to me to put the 88 out of reach for litigation. Just a guess, but I wouldn’t doubt that this was THE major worry of Duke University in settling this out of court. I hope the three LaCrosse players got a healthy pound of flesh.
Sad that the 88 elitist leftists in the faculty will never be held accountable....but it looks that way.
I wish some wealthy sympathizer would buy bill boards across the country and just list the names of the 88 professors from hell for everyone to remember and maybe fire off an e-mail or two to those losers!

I imagine that the 88 are included, for reasons of agency law and respondeat superior that are of interest to nobody but lawyers. Any good release will include "all agents, employees, and contractors of defendant," and that certainly includes the 88, despicable as they are.
If Duke was frightened enough (or didn't offer enough money), a settlement agreement may have excepted the faculty members of shame, but I doubt it.
My educated guess (I tried civil cases for about 15 years) is that the settlement is legal fees and all other expenses times three. Three times special damages (out of pocket money) is the rule of thumb for an early settlement. That should be enough to compensate for the 88's misconduct . . . and avoiding the misery and expense of a trial, for both sides.

Wild guess. Duke pays each player $20,000,000 plus their legal fees. Players leave Duke University and gang of 88 alone.
No one will confirm or deny it.
Duke probably needed a special printer to print checks with that many zeroes.
It doesn’t seem as if any further actions will be taken against the Stalinist Committee of 88. The statement by the three wrongly accused young men made brief reference to “...others determined to railroad Duke lacross players...”
That was probably a reference to those pathetic excuses of professors. I’m glad Duke had to pay up, but real measures to improve Duke University have still not been undertaken. The president of Duke University is both a coward and an accessory to an intended frame-up, and he must go. The Stalinist committee of 88 need to be immediately disciplined. What is a university if it is not it’s faculty? Those posers need to be removed from Duke University as soon as possible. Whatever knowledge they claim to bring to Duke has been far overshadowed by their lack of honesty, integrity, character, courage, and committment to any man’s fair and decent treatment in our legal system.
Understood - However, the crime was public; brought with public dollars. The lacrosse team is certainly the greatest victim, but the accusations were meant to indite all white middle-class young men. Therefore society is also a victim of this outrage and as such my wish is not for the benefit of the players rather for all of society. It is how we keep this kind of thing from happening again (perhaps even to my own children). Some public shame and humilation will be a better deterrent to make our society safer from false public accusations!
