Infamous "Duke 88" (Professors Who Adjudged Lacross Guilty) To be Huge Civil Suit Targets

A group of local lawyers all went to dinner least night.

Topic was Nifong and the damages NC will pay to the accused. There are questions of sovereign immunity, of course, and other issues but we all agreed that this was only the tip of the litigious iceberg.

In the civil litigation that is sure to follow, Nifong is one target, with few dollars, etc. The real targets will be the Duke 88. These are the professors who signed the now infamous letter adjudging the lacrosse players guilty and worse. That letter was then published as a full page ad in local newspapers and reprinted across the country..

These professors acted as individuals, with no corporate protection, insurance or shield. They acted outside their employment by Duke, etc. As such, they can be attacked and picked off, one at a time, with full and unrestricted individual liability, as targets of libel, slander and false light litigation. With no insurance, they wil even have to pay for their own lawyers.

Plaintiffs are well within statute of limitations.

Of course, as soon as one professor is served, he/she will go running to his/her lawyer. Their lawyer will play “let’s make a deal” by implicating others. Then they will sue the most hated professor, which will set the high dollar damages expectation for the rest of the cases. Others will then want to settle fast.

Even better, each of the three plaintiffs cam move separately against all 88 individually. The profs will fold like a house of cards.

Lots of fun. Big dollars.

Slander and libel, assault and battery, theft and fraud, trespass... They are actionable as "intentional torts", sort of a civil criminal tribunal-- almost no policy will defend or pay judgements. Maybe you have a different kind of homeowner's policy.

You forget one thing: the parents of the plaintiffs are totally pissed off and they may be in the mood to recover some of their costs or at the least embarrass a university that behaved so badly after takinbg their money.

I did not forget it, and I think there may be ways they can proceed—against Duke, but probably not the Eighty-Eight-Otherwise-Unemployables. I still maintain a lawsuit will not put a damper on this kind of behavior. Only alumni can do that, and they will not do it.

One of the benefits of being a liberal professor at a marxist institution is that you are like a liberal editorial page editor at the ny Slimes. You NEVER have to face any challenge or defend your liberal views. A kid hits you with an impossible contradiction in your logic? Flunk him.

I am going to enormously enjoy seeing these leftist cowards get their comeuppances. Kick the white boys when they're down plays well with the chip carrying black racists on the "black studies" faculties and the feminazis on the womens' studies faculties. I wonder how well "defend your vile behavior in court" is going to play?

First will the players be able to prove damage, I'd say yes. It would be wonderful if every one of the jackasses was impoverished and fired. Id love it

It protects us from suits by them when we make comments about them, where they are public figures.

The point about the professors was that because of their position inside the halls of the University, and because they spoke, publicly ("ex cathedra" itself!) from a special standing as in such a position of authority, in a position to know more than the general public -- that an action against them for harms by false lights, or even defamation, could proceed more vigorously.

I was so excited when I read this headline I actually screamed ‘Yeah!’ out loud (and I’m alone in the house)...I am enjoying watching the left wing fascists in this country try to backpeddle on this issue...and the boys and their family speaking so eloquently about justice and fairness...we needed this reverse racism scenario to blow up so publicly...this has been a great weekend for America.

The ad in question not only doesn’t say anything about the Lacrosse team, it doesn’t say anything at all. In this case, the utter vacuousness of the Left was fortunate.

Wasn't that the goal of the Civil Rights movement? That we judge people on their character, not on their skin color? That we become a 'color-blind' society? The fact is, most civil rights leaders don't want white people to not see their color- they want us to see their color and then treat them in a compensatory manner because of all the ills done to their ancestors.

I don't see skin color as the first or last definition of a person, I judge people on their acts. An racist is a racist, no matter what color they are. A jerk is a jerk, no matter what - and that's how many whites react to people of color. And that's what pisses them off.

I have Chubb and had an investment, as a limited partner, in an investment partnership. I and a number of limiteds sued the general partner and then were counter-sued for libel and defamation of the general partner. Several of us (all Chubb clients) turned over the counter-claim to Chubb and were defended by it. We eventually won but Chubb paid not only my portion of the legl fees but also my other partners.

It is interesting to note that these are all the so called “soft (headed) sciences,” arts and sociology/anthropology programs, social agenda studies, the ones that students take who don’t want to work hard, and have a political (liberal) axe to grind, and can slide into some well paying, social engineering job in the public sector.

All the hard sciences and programs where actual facts and data are necessary to reach a conclusion seem to be missing. That is not to say that they are bereft of whack-job professors, but that they are more inclined to critical thinking, and actually might have waited to see what the verdict was before shooting off their mouths.

Having had to take core electives in many of those programs, I know whereof I speak.

At minimum, the LAX accused should have their enormous legal expenses reimbursed, their tuitions refunded with interest, and issued a legal letter of apology from the college, absolving them of any and all responsibility in this farce, signed by the university president and maybe those 88 weasels (just for fun). Same for the LAX coach. Nifong should have to pay the bulk of the restitution by selling everything he owns.
