By RITA FREEMAN The Orange County Register LAKE FOREST – The city is violating day workers' First Amendment rights by enforcing a law that prohibits them from soliciting work on the sidewalk, according to a lawsuit filed by the ACLU on Thursday.

The civil rights organization also requested a temporary restraining order this morning to ensure the city does not enforce the ordinance. City officials say it isn't enforced after a legal decision over a similar law.

The ACLU filed the federal lawsuit in Santa Ana on behalf of day workers groups, La Asociacion de Trabajadores de Lake Forest (Workers Association of Lake Forest), Colectivo Tonantzin and the National Day Laborer Organizing Network.

"They have the fundamental right to solicit work just like a business can advertise a sale … or a Girl Scout can sell cookies outside a market," said ACLU attorney Nora Preciado at a news conference today. "It's illegal and discriminatory. This country has been built on the hands of many immigrants."

The lawsuit alleges day workers who congregate around Jeronimo Road and Orange and Cherry avenues to look for work have been told by police officers they cannot stand on the sidewalk to solicit work. The officers also discourage contact between the day laborers and employers and others have been cited or arrested, the suit said.

According to the city law, passed in 1993, workers are prohibited from standing on the sidewalk or street to solicit work. It is also unlawful to stop or park a car in order to hire someone off the street.

Lake Forest City Attorney Scott Smith said the city does not enforce the ordinance. The city reviewed the law and decided not to enforce it after Glendale lost a case based on a similar ordinance about three years ago.

Smith said someone was cited erroneously in January and the case was dismissed.

"We're absolutely committed to not enforcing it," Scott said.

The city has until Monday to respond to the injunction request. No hearing has been set.

In addition to the city, the City Council and Lt. Jay LeFlore, chief of police services, were named as defendants.

It would actually be quite easy to stop the ACLU. Enact legislation that prohibits the ACLU and it’s lawyers from collecting their fees from the American taxpayers!

Hmmm, this could get interesting.

I wonder how the Doctrine of Laches applies to this activity. Does a criminal have the "right" to loiter, panhandle, and intimidate the public unfettered and without interference from those charged with keep public order? Or more plainly stated: "What gives criminals the right to complain about anything?!"

Anyone who is in this country illegally, or who cannot prove their identity is already a criminal. No other fact of this "problem" need be examined.

Of course they're dealing with the ACLU so I doubt common sense will even enter the picture...

I am hoping that was the point. I was a afraid that a connection was being made between legal immigrants and illegal aliens and an attempt to excuse the foreign invaders.
