11-Year-Old Arrested For Using Rubber Band Gun OCOEE (Florida), June 7: An 11-year-old Ocoee boy was arrested for playing with a toy gun. Police said the arrest was necessary, because it was a safety issue.

The boy was using a rubber band gun and his father said the kid did nothing wrong, but police said they take it as a serious threat and the 11-year-old is facing felony charges.

The crime isn't very common, but Ocoee police said it is serious. It centers on an 11-year0old boy and his toy short-barreled shotgun.

The incident started Sunday afternoon, when the 11-year-old was riding in his dad's pickup near Clarke Road and White Road in Ocoee. Someone driving nearby called police after they said the boy pointed what looked like a real gun out the window. The victim told police she was afraid for her life.

"With that type of behavior, it's hard to tell if it's a real gun or not, especially in their car," said Sgt. Randy Conyers, Ocoee Police Department.

But, according to the charging affidavit, the 11-year-old's dad said nothing was wrong with what his son had done and that he used to do it as a kid. The boy even told police he was pretending to be a cop and thought the victims were laughing with him.

The gun itself only fires rubber bands and was checked into evidence. Police didn't comment on the weapon's color or release any images. Still, the victims said they were frightened and, police said, toy or no toy, the charges are justified.

Eyewitness News spoke to the father of the suspect on the phone. He said his son is out of juvenile detention and that a judge told him the case would be dropped. He also confirmed that the gun was black, but that it looked more like a stick than a gun.

Interesting.

I would estimate the reverse, about 20% will and 80% no way.

As I recall that is about what they got in California on the AR and SKS bans.

Anyone have any hard numbers on that mess in CA, how did it turn out?

What kind of idiot father lets his son point a gun, toy or otherwise, out the car window at a random stranger?

Sure, kids play cops n' robbers, cowboys n' Indians, and so on. But playing like that is one thing, pointing a (toy) gun at a complete stranger is another.

When I was younger, I had a toy gun that I got in Williamsburg, VA - a very real looking flintlock pistol (it came without an orange tip). I played with it around friends, but I was taught to NEVER point it at a person and pull the trigger.

When we were that age we were constantly playing war. In the winter, it was either the Battle of the Bulge or the Marine retreat from Chosin Reservoir, summer brought on our reenactments of jungle warfare against the Japanese. We carried replica German Lugers, old drill muskets (wooden barrels painted black) and real BB guns. We were all over the place, woods, fields, swamps and everybody's back yard.

Nobody ever said a word against us.

That’s what I’m saying. I’d watch John Wayne in “The Alamo” on TV one evening and the next day my friends and I would be outside swinging our rifles at imaginary Mexican soldiers trying to climb over the mission walls to bayonet us. Didn’t matter that some of us had shovel handles or toy M-16s for our muskets. We were very creative had fun and nobody actually got killed.
Speaking of which, maybe we should make all Border patrol agents watch “The Alamo”. Might give them some good ideas.

After seeing that photograph, I don’t blame the police! A toy gun, looking realistic at a distance, has no business as a toy!

Toy guns are not playthings. Kids need to learn to respect them from early age on. Perhaps there would be fewer accidents.

Depends on what the toy gun looks like. Long story short group of boys running around at night with Airsoft pellet guns that look like M-16’s and etc. Somebody called the police, police took them down at gun point. Wasn’t sure if the cop was madder at the idiocy of the boys or the fact that he could have shot one if they hadn’t obeyed instantly. Trust me, at night you can’t tell a pellet gun from a real gun.

Yep they can arrest an 11 year old boy with a toy gun, but can’t or won’t arrest an illegal alien.

I guess the cowards no longer want to go after real criminals, just those it’s easy to push around.

I have tried recently to get info on what the final numbers and general trend was in the California SKS confiscation as it only was one rifle, not disarming everyone. Even with that I think it was a really big no-show. If anyone knows, hit us with a link or ping.
