Justice Breyer: U. S. Constitution should be subordinated to international will

[snip] Breyer had held that a ruling by the European Court of Human Rights that homosexuals had a fundamental right to privacy in their sexual behavior showed that the Supreme Court’s earlier decision to the contrary was unfounded in the Western tradition.
“We see all the time, Justice O’Connor and I, and the others, how the world really â it’s trite but it’s true â is growing together,” Breyer said. “Through commerce, through globalization, through the spread of democratic institutions, through immigration to America, it’s becoming more and more one world of many different kinds of people. And how they’re going to live together across the world will be the challenge, and whether our Constitution and how it fits into the governing documents of other nations, I think will be a challenge for the next generations.”
In the Lawrence v Texas case decided June 26, Justice Anthony Kennedy gave as a reason for overturning a Supreme Court ruling of 17 years earlier upholding sodomy laws that it was devoid of any reliance on the views of a “wider civilization.” [unsnip]

Recent attacks on "activist judges" by legislative bodies ... Don't you know - we shouldn't criticize judges.

Recent attacks on "activist judges" by legislative bodies could be putting the concept of an independent judiciary at risk, retired Associate Supreme Court Justice Sandra Day O'Connor said Friday. "These are appalling times,"
Boo effing hoo, Sandra. Go play a few rounds. If you want a judiciary that stays independent, then encourage it to stay within its Constitutional bounds and stop trying to retrofit society for liberal paradise.

"These are appalling times," O'Connor told a crowd of 700 during a moderated discussion about her career at the University of Tulsa. "There is so much rancor and dislike going on."

When Judges like Massachusettes' Margeret Marshall make up new laws in violation of the ones agreed to by the people or it's legislature, the people should be angry. As Abraham Lincoln taught us many years ago -
-let every man remember that to violate the law, is to trample on the blood of his father, and to tear the character of his own, and his children's liberty

Judges are gods, even if most were lawyers first. But after their metamorphosis all thoughts of themselves disappear and they are turned into beautiful judges.

No, O’Connor and her ilk are lucky they don’t get removed from office, as they should be, for touting “international law”. Screw international law. Abide by your oath. You swore to it.

Well, ya know, Sunken, the judiciary is what saves us from the tyranny of the majority in a Republic utilizing a democratic process, however... Our constitutions forbids them to play both ends against the middle like a bunch of politicians like she did. And it certainly forbids them legislating from the bench like the majority of the Supremes still do!
When they do these things, and wipe out entire well established legal and constitutional doctrines, they should not only be criticized, but in repetitive and severe cases they should be promptly impeached and removed in a swift trial!!!

O'Connor told a crowd of 700 during a moderated discussion about her career at the University of Tulsa. "There is so much rancor and dislike going on.There would be little rancor if judges would stick to being judges. But they want to legislate. Thus, they are attacked like any other politician.
