The basic problem is that Constitutional rights are conferred at birth not conception.
This is a fundamental problem that should be corrected with a Constitutional Amendment.
No court would be able to “interpret” that.

But rights belong to an individual as a consequence of being human. Of course citizenship is conferred at birth...I’m sure other privileges and rights are worded similarly.
But human rights overide that.

The Preamble, the very foundation of the Constitution, makes it clear that the document's purpose is to secure the blessings of liberty to ourselves AND our posterity.
The word "posterity" is not only inclusive of the unborn, but of the as-yet unconceived.
"We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America."
