WASHINGTON — The Supreme Court upheld the nationwide ban on a controversial abortion procedure Wednesday, handing abortion opponents the long-awaited victory they expected from a more conservative bench.
The 5-4 ruling said the Partial Birth Abortion Ban Act that Congress passed and President Bush signed into law in 2003 does not violate a woman's constitutional right to an abortion.

This decision specifically bans a procedure and does not set any time limits.
Start with the Preamble ... "establish Justice" ... "secure the Blessings of Liberty to ourselves and our Posterity." I don't think that allows one to murder our Posterity, do you? Or are you trying to argue that the right to exist is not Constitutionally protected?

No. One of the big misunderstandings amongst the masses is that abortion is legal only in the first trimester. Anyone can have an abortion up to the minute the birth takes place. That is Roe v. Wade.

Roe v. Wade is a States Rights issue. Currently it is an unconstitutional expansion of the Federal Judicial and Legislative powers.

5-4 was about the miracle it would have taken the Fla. leg to pass new laws and do another state wide recount in a matter of days.
The very kinds of justices we should expect from Rudy Giuliani. He will promise us a Scalia and deliver us a Souter.
It will be interesting because they'll have to get really rabid about this in order to whip up a frenzy among their supporters. They'll have to PUSH abortion as a right, which is a double edged sword for them. They've been trying to become more centrist in the eyes of the voters. That's essentially how the Dems won several seats in the House and Senate last time, by running supposed pro-life 'moderate' candidates. They're going to have to go back to the feminist playbook this time around, pushing the idea of a pro-abortion President to uphold their precious 'right to choose'.
This, FRiends, is why we must NEVER allow a Demonrat to become president!!! (Nor a RINO)

Well, hopefully someone will take the bait and raise a challenge on that basis, and then if it gets properly struck down a separate challenge can revisit the Stenberg case. It’s worth noting that Kennedy joined the dissent in Stenberg, meaning that he would’ve left it up to the states then, and there’s no reason to think he’s changed his mind on that now.
Indeed. I understand that it was Casey that got us away from the original Roe trimester framework. My point is that I think that however bad Roe is as law and as science, most Americans do not view abortion in the absolutist terms that activists on both sides do. Rather, I believe that, aside from the all too critical detail of drawing the liens, you would get significant majorities that would permit abortions early on in pregnancy and significant majorities that would prohibit abortions (with perhaps some very limited physical health exceptions) at the end of pregnancy, with the majorities at each end of the spectrum diminishing as you get towards the middle of term. I'm not sure where the majority 'break point' is, and I suspect it's different for almost every thoughtful person.
For that reason, I think that over time, somehow or another, we will get back to a position something like that. It may be different in different states, but I don't think abortion will ever be generally unlawful in the US, and I don't think it will ever be 'on demand at any time' again.
