This case is most likely headed to the U.S. Supreme Court and we have a tidal wave of work to do before it gets there.

Why is this ruling so radical? Because the decision defies almost 70 years of legal precedent. All courts before this — save one — have ruled that the Second Amendment is not an individual right to bear arms, and this is the first Federal Appeals Court ever to declare a gun law unconstitutional based on the Second Amendment.

In her dissent, Judge Karen LeCraft Henderson wrote that Second Amendment rights relate to “Those militia whose continued vitality is required to safeguard the individual state.” Unlike Judge Henderson, the two judge majority ruled against decades of legal precedent…

… And completely disregarded the democratically-expressed will of the people of the District of Columbia, depriving D.C. citizens of a strict handgun law enacted thirty years ago.

Talk about judicial activism! We can’t help but note the unbelievable hypocrisy here too. Conservatives cry and gnash their teeth about activism from the bench. This decision is judicial activism at its worst.

Judge Silberman, who wrote the majority opinion, is well-known for his close ties to the right-wing. Now — with quintessential judicial activism from the bench — the gun lobby threatens to achieve through the courts what it has been unable to do in Congress.

The Brady Harpies have their collective panties in a wad over the Appeals Court Ruling. I would love to buy those two judges a cold beer after a day at the range.

Just for the sake of disclosure and in the spirit of Sunshine Law week: I am writing this from the computer in my gunshop and my concealed carry gun is on my hip.

Too many people get their minds full of ways to supposedly "do good" after a tragedy like what happened to Mr. Brady.

Most times they are hopelessly wrong headed. This is defintely one of them.

I just love this. Liberals are all for judicial activism as long as it advances their agenda. When it threatens their agenda, it must be firmly opposed. The Constitution can only be interpreted as liberals want it to be interpreted. If judges cross liberals, we're on the road to despotism. Of course judicial tyranny is never an issue when its used to expand governmental power and limit freedom. That's the kind of judicial activism liberals are right at home with.

I guess to these enemies of civil rights there is no law that could ever violate the Second Amendment. They read the Bill of Rights as if the 2A is just not there. They ignore overwhelming history and legislative intent that clearly affirms 2A to be an individual right.

If the 2A is not an individual right then there are no individual rights. It's all one big collective kumbaya.

Liberals are threatened by individual freedom - it removes one more element of dependency upon the state. And it eliminates their indispensability and that of the government they run. There's a logic to their nuttiness.

The hypocracy comes from the boneheads at the Brady Bunch.

This isn't judicial activism. This ruling created no law. This ruling created no "right" where none previously existed. No, this ruling overturned a bad law and ruled the constitution trumps bad law.

Exactly what they are supposed to be doing.

Not all legal precedent is good.

One only has to look at the recent decision regarding eminent domain to see that some ruling need to be overturned or legislated around. Dred Scott, anyone?

Think I'll hit the range this weekend and maybe drag a lib or two with me. Direct "shock therepay" desensitization to weapons is a remedy for hoplophobia. It is amazing that so many people who fear these inanimate objects have never, by hand or eye, sampled one.

Yep. In their tiny minds, the gun nuts, Christian theocrats and Wal-mart all stand in the way of Utopia. They can't stand the thought history might be reversed. That goes against their view of the world's ordained march down to the cultural sewer.

Exactly. There have been very few gun rights related rulings in memory that I agreed with.

They want to "save" the 22,000+ gun laws that have done nothing to make us safer, that governments had no legitimate authority to pass in the first place, and do nothing but make sure we are easy victims?

I sent a donation to the NRA-ILA today. More gun owners should consider joining and supporting the NRA, GOA, and SAF.

My gifts to NRA/ILA are not, because ILA is dedicated to affecting legislation, hence, no 501c-3.

Its funny to hear liberals defend legal precedent. If they used that argument in the 1950's, we'd still have a Jim Crow apartheid South. If they used that argument in the 1970s, abortion would still be banned. They just hope folks don't notice how desperate their arguments get when they have nothing left to fall back upon.
