Quite possible and I'm no attorney, though I have a nephew who is one, and I did spend the night at a Holiday Inn Express once.
I seem to remember, and the attorneys here can correct me, but I think an appeal does not necessarily preclude a judge from ruling that you must serve your sentence while under appeal.
I am probably wrong and stand to be corrected.

I suspect it depends on each case the same as in Britain but even if he does serve time I suspect it will be your equalivanlent to custody and not real jail if an appeal or retrial is granted.
