Did Justice Prevail in the Case of the Dr Vs. The 11-Year Old Skater?

Dr. Alexander Dlugi had sued student Lauren Ellis for loss of income and pain and suffering that was the result of a bike/skate collision between the two in 2003 when Ellis was only 11 years old.

After closing arguments were heard, the Morris County civil jury deliberated for only 15 minutes today and ruled in favor of the teenager. The jury agreed that Ellis was not responsible or at fault for the accident that happened on Sugar Maple Row that October day.

The physician -- who earned $800,000 in 2004 and got $750,000 for half the sale of his former fertility practice -- also maintained that he deserved about $160,000 to cover income he lost recuperating from his injuries.

I would like her and her parents sue him for mental anguish. Being wrongfully sued is very stressing.

Justice did not prevail, but the legal system came through, for a change.

Except for the absence of making the loser pay all legal fees.

the doc was overtaking the girl, rang the bell on his bike and yelled "watch out"..(who the he*l has a bell on their bike anymore besides pee wee herman??)

Knowing how insurance companies work, I'll point out that if this guy was injured in the collision and had to be treated at a hospital for his injuries, then his insurance company would go to great lengths to recover whatever money it could from the other party.

If they weren't able to do it themselves, then it seems highly unlikely that he'd be successful.

Improper passing technique, combined with an over active ego, seasoned with a large dollop of unmitigated greed.

Don't cyclists get upset if another vehicle doesn't properly pass their "vehicle" by moving fully leftward into the next lane of traffic?

If not, then I have idea what their 1-fingered salute is for, when someone only moves leftward enough to miss them.

They should sue the Dr. for her damages. The jury found she was not at fault, so since there were only two people involved, he must be at fault. Pay up Doc!

From my experience, insurance companies sometimes put the name of a policyholder on a suit that they are filing. Thus this suit oculd have been filed by Dlugi's insurance company.

I participated in an ALS fund raising walk last fall, complete with people with canes and wheelchairs, and elderly, and you wouldn't believe how rude the bicylists were....nearly running down people because they insisted that they had special rights, apparently......

maybe slowing down and passing carefully would have set better with the ALS victims......
