Imagine the outrage from this story if one cuts the "gay" from the story and substitutes "conservative". The outrage would spill out....but throwing food at the queers, hell, that's just good old fun "conservatism".

Pretty sure throwing objects from a moving vehicle isn't and comes somewhere under the more serious categories of "assault".
hate crime = special rights and protections under law (where all are equal).
Gender can be determined by many methods, but are we talking physical gender, emotional gender or legal gender? It's not a simple X or Y thing in San Fran.
