Fulton DA seeks charges in shooting of 92-year-old woman in her home
The Fulton County district attorney will seek felony murder charges against at least one of the three Atlanta police officers who shot and killed an elderly woman in a botched drug raid, according to one of the officer's attorneys.
Defense attorney Rand Csehy, who is representing Gregg Junnier, said he received an e-mail message from District Attorney Paul Howard's office today saying the DA would seek charges before a grand jury Feb. 26.
"It's an overbroad indictment," said an angry Csehy. He said that Howard's office has "broken with the federal government. Paul Howard is no longer part of a joint investigation."
Csehy said that his client had been cooperating with authorities.
On Nov. 21, three narcotics officers went to the home of Kathryn Johnston, 92, to execute a "no knock" warrant. A shootout ensued during which Johnston was killed and the three officers were injured.
"No knock" warrants are frequently issued so police can get inside before suspects can destroy or flush any drugs. When the officers kicked in the door, the elderly woman apparently got off five shots from her own revolver, hitting all three police officers.
Friends and family members of Johnston contended that she was a feeble and frightened woman, who rarely ventured outside after dark and knew few people. And they say that she was never involved in any drug activity.
The three officers, Gregg Junnier, Gary A. Smith and Cary A. Bond, were put on administrative leave.

There's doubt the informant even existed. The cops can't seem to get their act together.
And I still think when they have had to face other cops and say they were wounded in the line of duty by an old lady with a rusty pistol it's got to be humiliating.
We have the right and the obligation to defend ourselves and to preserve our lives. When someone invades your house you have the right to shoot and kill the invader. If the invader is an undercover police agent who doesn't indentify him/herself, you will mistake the police for an invader and shoot to kill.
Recall that the mistake was on the part of the police. The woman was within her rights.
The police have been trained never to hesitate, never to ask "is this the wrong house?", so they blast their way in.
The outcome of this was tragic. But the cops were wrong.
I have to ask a question. If the amount of drugs in an abode is small enough to flush, does that warrant a no-knock raid?
No Knock raids should be for someone with a bail of MaryJ and with the state of low volume toilets these days, it'd take you a month of Sunday's to get that down.

In my opinion those cops should be dropped through a trap door with a rope around their neck.
But only AFTER the Judge, the DA and the Chief of Police precedes them.

I've already stated that I've misspoken without knowing the facts of the incident. A clear cut case of open mouth insert foot. Thank you continuing to chastise.

When group gears up for combat, crashes down the door of an American citzen's home, then kills the homeowner when he/she attempts to defend their home, they are a narco- death squad.

I think the cops may have been a little upset since they didn't get to shoot a dog that day.
They made up everything on the warrant to go in. She shot at the criminals breaking down her door. Now, I can see it being manslaughter rather than murder, but I hope all three cops go to jail.
Of course, the newsbabes know all the facts. There is no chance that they were reporting spin by the cops.

If the amount of drugs can't be flushed in a short period of time, there's no need for a no-knock raid, right? And if it is small enough to flush, is it worth it to make the bust considering the risks involved in these raids?

You know it. The family pet is typically the first kill upon dynamic entry.
No sympathy for these cops. But I hope this prosecutor isn\\\'t trumping up the charges too high to get headlines. If the jury refuses to convict on the most serious ones, it will look bad. That\\\'s exactly what happened in the Rodney King episode.
