This week Durham District Attorney Mike Nifong could be slapped with more charges related to his handling of the Duke Lacrosse case.
This week the State Bar Council will be holding its quarterly meetings in Raleigh. During this time, the agency could add ethics charges against the Durham district attorney.
Nifong recused himself from the Duke Lacrosse case shortly after the state bar filed an ethics complaint against him last month. He's accused of misconduct for statements he made to the media last spring.
In a letter obtained by Eyewitness News, defense attorney, Joe Cheshire requested to meet with Nifong in March about the statements.
"I do not understand why you will reportedly speak to the media in such certain, condemning terms before all the evidence is in, but you will not have the courtesy to meet or even speak with a representative of someone you have publicly condemned," Cheshire stated in the letter.
Nifong could also face additional charges for withholding DNA evidence that was favorable to the accused players. Evidence that is now in the hands of the state's Attorney General.
"We accept these cases with our eyes wide open to the evidence, but with blinders on for all other distractions," Roy Cooper said.
The State Bar Council meets today.
The council will decide this spring if his public comments about the case were a violation of the professional rules of conduct. Nifong's ethics meeting is scheduled for May.
No Federal Probe
The U.S. Attorney General's office has responded to Congressman Walter Jones' request for a federal probe of the Duke Lacrosse Case.
In a letter delivered Thursday, Alberto Gonzales' office wrote that it would be, "Premature to initiate a federal investigation pending a criminal trial."
This means the Attorney General will not be getting involved in the case at this time.

Oh no? What Nifong has done under color of law is ok? I think you have invented a new way around Civil Rights legislation. Just bring charges against people we don't like, run the process until the legal fees bankrupt them, then drop the charges. No harm no foul - in your view.
It is not just the outcome that violates Civil Rights, but abuse of a very expensive process to begin with.
Even worse we know he has physical evidence that demonstrates that the allged crime never actually happened, and furthermore that the accuser is a liar on so many other counts, that her credibility on this count is shot to hell.

ugh. Doesn't mater how cute, or well defined, or shapely. If the brain and heart are ugly, the legs just look... icky.
I still work out with weights. I was truly commenting upon the lack of balance and symmetry to breadth of those "legs'" muscle development.
The CALVES are not as well defined as the thighs. If he doesn't work his calves better, he's gonna suffer knee and ankle trauma at some point, if not make him a ready candidate for a hip o two replacement in his older years.

New Developments in Duke LAX Case

(01/16/07 -- DURHAM) - The state Attorney General's Office now has boxes of evidence in the Duke Lacrosse case. The FBI escorted the boxes into the downtown offices Tuesday evening.
The boxes contain thousands of pages of documents and evidence in the case. They include investigator notes, witness statements, pictures and videotapes.
We know at least one tape features the accuser during the photo line up that's now in question. This is the first step for the new prosecutors who have to decide whether to go forward with this case.
It's not clear how long it will take officials to sift through the boxes and re-interview witness.
Attorney General Roy Cooper has released this statement saying, "Our attorneys will immediately begin examining this material. These files contain a substantial amount of information, and we will work carefully to ensure a full and fair review." The State Bar Council handling Durham District Attorney Mike Nifong's ethics complaint will be meeting on Thursday. But there's no official word whether Nifong is on the agenda. -cut-

I don't see any irony. North Carolina has no criminal statute under which it can prosecute Nifong. The federal government does. Hence the desire for federal involvement.
As I understand it, DOJ has jurisdiction over violation of the civil rights of the accused. Earlier in this thread, fabricating evidence was listed as an example of the type of activity by a government official that DOJ investigates as a violation of civil rights. If that is considered a violation of civil rights, it seems likely that hiding exculpatory evidence and informing the court that such does not exist would be as well.

The federal government has the authority to pass legislation necessary to ensure that states offer people equal protection under law, and do not infringe upon people's life, liberty, or property without due process of law.
To be sure the Fourteenth Amendment which grants such authority is very badly written, with the effect that the federal government often imposes its will against states inappropriately (e.g. when a locality wants to set up a nativity scene) while ignoring more serious wrongs by states against people (e.g. infringing the right to keep and bear arms). But I think it would pretty well grant the federal government some authority here, if the federal government chose to exercise it.
Just a layman's thought, but could the FBI be doing an indepedent investigation?
Don't waste your time on fact to Ditto. He/she isn't interested in what's right for the Duke players, just denying them their rights.
The FBI escorting evidence from an NC prosecutors office to the NC AG. I can say for a fact, but no that does not sound like SOP to me.
In fact I wonder how this came about? Did the NC AG request this? One would have to expect that this is a sign that some combinaton of Wilson, Gottlieb and Himan are under investigation and this is a precaution against one of their friend "losing" some evidence in transit. I would think SOP would be someone from the Durham Co. DAs office or the DPD would take the evidence to the NC AG.
