Nifong a Topic at State Bar Council (and Feds Decline to Act for Now)

This week Durham District Attorney Mike Nifong could be slapped with more charges related to his handling of the Duke Lacrosse case.

This week the State Bar Council will be holding its quarterly meetings in Raleigh. During this time, the agency could add ethics charges against the Durham district attorney.

Nifong recused himself from the Duke Lacrosse case shortly after the state bar filed an ethics complaint against him last month. He's accused of misconduct for statements he made to the media last spring.

In a letter obtained by Eyewitness News, defense attorney, Joe Cheshire requested to meet with Nifong in March about the statements.

"I do not understand why you will reportedly speak to the media in such certain, condemning terms before all the evidence is in, but you will not have the courtesy to meet or even speak with a representative of someone you have publicly condemned," Cheshire stated in the letter.

Nifong could also face additional charges for withholding DNA evidence that was favorable to the accused players. Evidence that is now in the hands of the state's Attorney General.

"We accept these cases with our eyes wide open to the evidence, but with blinders on for all other distractions," Roy Cooper said.

The State Bar Council meets today.

The council will decide this spring if his public comments about the case were a violation of the professional rules of conduct. Nifong's ethics meeting is scheduled for May.

No Federal Probe

The U.S. Attorney General's office has responded to Congressman Walter Jones' request for a federal probe of the Duke Lacrosse Case.

In a letter delivered Thursday, Alberto Gonzales' office wrote that it would be, "Premature to initiate a federal investigation pending a criminal trial."

This means the Attorney General will not be getting involved in the case at this time.

Now that it's obvious there will be no criminal trial, I wonder what his story will be.

No surprise that Gonzales shows no eagerness to get involved where victims are three wealthy white males. He seems the do-nothing type.

what upsets me is all the media journalists (whores) who are falling all over themselves to give Nifong every excuse in the book. (just one time, his first big case, never was bad before)

This is because these media journalists (whores) are trying to kiss but to the OTHER prosecutors in their OTHER stories.

If a nifong effect takes hold, no prosecutor will EVER talk to reporters again.

The Feds refuse to protect the boarders, fight the terrorist the non politically correct way, and now do nothing with a D.A. clearly out of line.

What can we do?

The bar seems to be looking for ways to nit pick their way out of actually pursuing this.

The DA will haul your butt to court for a traffic ticket but when one of their own accused of wrong doings they turn the other way. A jury should look at the facts and hold him accountable.

Nifong's intemperate remarks to the press about the case he was trying could be written off as lack of maturity or poor judgment, for which a reprimand might be in order.

However, "Nifong could also face additional charges for withholding DNA evidence that was favorable to the accused players," if proven true, would show that he has character defects that should disqualify him from practicing law or working in any position of trust or responsibility.

In that case, he may have to join the French Foreign Legion. His nom de guerre could be, "Sac d'Engrais." If he served well, he might be promoted to "Caporal Sac d'Engrais," and, after retiring and gaining French citizenship, he would be called "Monsiuer Sac d'Engrais."

"What can we do"?

Short of rising up in arms, bend over and take it.
BTW, is Nifong a Carpetbagger or a scalawag?

nope.

just am surprised people don't see Nifongs actions as BUSINESS AS USUAL for prosecutors.

Nifong's unethical conduct is not the exception, it is the rule.

This is a slam-dunk for the Feds if they want it.

Any of you legal-eagles out there: Is there any reason why the Feds would NOT want to take action in this case?

Apparently the US Attorney General and his flunkys only prosecute law officers when they interfere with drug trafficking or try to stop border violations.

Ubuntu! "fast."

http://iambecauseweare.wordpress.com/

Reclaiming our Spirit- Join us in a three day fast!!!

This is a call to reclaim our spirit. To fight the way we know how. And to following the paths our ancestors set before us.
Join Black Women in Durham as we expel and heal from the hatred spewed upon our bodies. Collectively we can cleanse ourselves and our community of this venom.
We are calling for a 3 day fast (Tuesday, January 16th - Thursday January, 18th), along with meditation and prayer as we ignite a collective power of healing.
This is not meant to be a hardship so please fast in a way that feels right to you. Many of us will be eating only raw fruits and vegetables and drinking lots of water and detoxifying teas. Please do what feels right to you. We will break this fast on Friday morning and continue to fast one day a week until…

for civil cases? all the time. Especially, in probate matters.

for criminal cases? RARE if ever.

They prosecutors always keep one tiny charge alive so they can justify the entire case. "see he was convicted of sooooomething" or "see he plead out to soooooomething" and thus viciate any claim.
