Nifong recusing himself from Duke Kidnapping and Sexual Assault case

Just heard at the top of the hour. Nifong is recusing himself from the Duke Case as prosecutor.

ABC News Law & Justice Unit

Jan. 12, 2007— District Attorney Mike Nifong has requested that he have himself removed from prosecuting the Duke Lacrosse rape investigation, ABC News has learned.

A source close to the investigation said Nifong sent a letter to North Carolina Attorney General Roy Cooper asking his office to assume responsibility of the case.

Three Duke Lacrosse players, Reade Seligmann, Collin Finnerty, and David Evans were indicted in 2006 on charges of rape, sexual assault, and kidnapping.


The rape charges were dropped in December after the accuser could not recall key details of the alleged attack.

is that 2d-in-command at Nifong's office reassigns the case to another prosecutor

How does a Special Prosecutor get appointed in North Carolina? Is Congressman Billybob able to answer that question?

In Texas the trial judge, not anyone in the prosecutor's office, makes the appointment of a Special Prosecutor. In a non-controversial recusal (say the DA's car is stolen), the judge will often appoint whomever the DA reccomends. In something like this...

Nah....Sovereign immunity. If you want justice see God. Government isn't in the Justice business. Nifong's career is over however. That is a good thing.

The defendants could sue the accuser but she doesn't have a pot to pee in. But it might be the right thing to do to " encourager les autres"
