How does a Special Prosecutor get appointed in North Carolina? Is Congressman Billybob able to answer that question?
In Texas the trial judge, not anyone in the prosecutor's office, makes the appointment of a Special Prosecutor. In a non-controversial recusal (say the DA's car is stolen), the judge will often appoint whomever the DA reccomends. In something like this...
I'm not sure (state special prosecutor), but I've just read that Nifong's letter re: recusal was to the state AG, asking THAT office (state[wide] attorneys) to take over.
Either way, the case should be gone soon, along with Nifong's bar membership.
With Nifong's recusal, the responsibility devolves to the state AG's office. The AG can take it on himself or appoint someone. I assume whoever ends up with it will just dismiss the case, but who really knows.
