Just heard at the top of the hour. Nifong is recusing himself from the Duke Case as prosecutor.
Smartest thing Nifong did since leaving his parents house..

I keep hearing that there will be a second complaint including the DNA stuff dropping shortly.

Yeah, the bar association charging him with his statements was just a first volley. Still I bet he cops a plea to resign his office, give up his law license for 10 years and no state prosecution. I hope then the DOJ swoops in.

He has humiliated (exposed?) prosecutors across this country; they are getting ready to take out the trash.
Now that there's an actual story out about this, I see Nifong still didn't do the right thing, unless it's just not been looked into yet. He should have at least noticed the court that he was recusing himself.
I'm not sure what everybody is hooting and hollering about so gleefully for, at least not yet. This isn't necessarily good news. Of course, I'm kind of a doom and gloom type, but this case calls for doom and gloom. :<
I wonder if Nifong had enough juice to actually prearrange for a particular person to be assigned by the AG's office to replace him. We know Cooper doesn't want to handle it because of the political ramifications with the black vote unless he wants the railroading to continue, which he might. Cooper could appoint a former DA now in private practice to take it up. Somebody in a private practice in a predominantly white middle-class area who doesn't have to worry about elections or patronage from many black clients would be Cooper's best bet, but he probably won't do that. He might even appoint somebody he knows in advance will continue the case and not dismiss, such as a black female as someone suggested.
This will also most likely cause a continuance of the Feb. 5 hearing, and that also helps Nifong (and Mangum). If/when somebody else is assigned to the case, they will claim they need much more time to review and can't be ready by 2/5, which is a reasonable claim. Then, after the review, if the new prosecutor dismisses before a hearing on any of the pending motions, Nifong (and Mangum) will have avoided further exposure and the boys will suffer because they will not have had the opportunity to expose the full range of Mangum's lies by having her cross-examined by their attorneys. In that case, the cloud will not be fully lifted until civil suit testimony is taken.
I realize the defense attorneys wanted Nifong to recuse himself so almost anybody else could be appointed and hopefully dismiss, which is certainly better than having Nifong go forward with a trial, but it's far from ideal, especially coming at this point just before the hearing.
This is Nifong stalling for more time after establishing that he's had an opportunity to talk to Mangum, and he's using the bar investigation as his way out since that is probably the basis for his request for recusal.
We don't know if that's the ultimate bombshell. We don't know what all Nifong instructed the cops in private with regard to the photo line-ups. There could be more in regard to the line-up procedure that's even worse.
I hope they do take that up. It is a more serious violation of ethics.
The defense can serve a subpoena, too, especially if they don't trust Nifong in fear that she won't show up and he'll make excuses for her by saying they forgot to serve her. The defense serving a witness they really want to have appear is a common tactic, even if the witness is technically a prosecution witness.
I don't know who generated the subpoena, but I wonder how the defense knew about the meeting which would give them the opportunity to serve her? Maybe somebody at the courthouse or the DA's office let it slip accidentally-on-purpose to the defense. I'm sure the defense has been waiting for any opportunity to serve her.
Couldn't resist that opportunity. Actually, I might enjoy seeing him in those fuzzy ones if he is in a cell with a 350 guy named "Bubba"!
That should be fatal to Nifong. I hope he does not get a slap on the wrist. Nifong has been around long enough to know better.

It probably was a subpoena from the DA's office. They have to subpoena witnesses. The defense brought the motions to be heard on the 5th pertaining to the IDs. Nifong wants Mangum to make a courtroom ID. It is common practice for the DA to serve any witness, even their alleged victim, with a subpoena to appear.
The defense probably doesn't trust him, though, and would likely suspect that he might deliberately fail to subpoena her, and so served her with their own subpoena, but I would then wonder how they knew about the meeting - how she would be where and when. Maybe somebody leaked the information, especially if it was set up to take place at the courthouse somewhere.
