Rape Charges Dropped in Duke Case

Prosecutors dropped rape charges Friday against three Duke University lacrosse players accused of attacking a stripper at a team party, but the three still face kidnapping and sexual offense charges, a defense attorney said. Joseph Cheshire and attorneys for the other players have said for months the woman told several different versions of the alleged assault.

Cheshire said Friday that the accuser now says she does not know if she was penetrated, which he said led District Attorney Mike Nifong to dismiss the rape charges.

Nifong did not immediately return calls seeking comment.

The accuser, a 28-year-old student at North Carolina Central University, has said three men raped her in a bathroom at a March 13 team party where she was hired to perform as a stripper.

The players _ Dave Evans, Collin Finnerty and Reade Seligmann _ all say they are innocent. Their attorneys have consistently said no sex occurred at the party and have cited a lack of DNA evidence in the case as proof of their clients' innocence.

I doubt that the purported victim will even be allowed to identify the defendants from the stand.

Kidnapping? For how long?

Since there is no DNA evidence, the whole case is reduced to 'she said, he (they) said'. Given the fact that her credibility was completely tanked by her false statement that she was raped, i.e., nonconsensual intercourse, and her other allegations, this case is essentially over. Nifong is trying to save face by continuing to pursue part of it, which is unethical. Up unitl now, he could blame the accuser. From here on, it's all his doing.

In case people aren't aware of the Scottsboro Boys case, it was about a group of young black men accused, without evidence, of gang-raping two white prostitutes.

I hope all those blacks in Durham who were "hang-the-white-boys" cheerleaders didn't spend all their money on crack and cognac this year, there's going to be a hell of a bill to pay when these guys sue your city.

Think about how that's gonna feel when they raise your taxes, so that those rich little white boys you hate so much can retire right out of college, thanks to your stupidity.

You deserve Nifong. You own him, you pay for him...

If Nifong doesn't charge this lying, depraved and unwashed sperm depository skank with several crimes -- he himself should be dragged from his office, tarred, feathered and run of town..

Then FORMAL charges and Law suites should commence against Nifong, the city, the county, the state and Duke University.

The D.A. may mean "illegally detaining" by kidnaping. He wants to get these guys on something - anything - so that he doesn't look like the complete fool we know he is.

Yes, her accusations clearly seemed questionable, and hopefully these accused will learn a lesson about the dangers of unrestrained drunken partying. But the attention this case got was ludicrous, especially from the talking heads. There are so many other cases of police/prosecutorial overzealousness that deserve more attention, people that are either dead, going to die, or serving ludicrously long sentences. Cory Maye, Richard Paey, Weldon Angelos, Sal Culosi, Kathryn Johnston. Why these cases are mostly ignored, and this one makes headlines everywhere, I guess I just don't understand.

She's a stripper. Of course people are going to "sexually harass" you. People pay strippers so they can sexually harass them. Give me a break.

Nifong needs to be prosecuted.

A guy who accuses white guys of attacking a black chick, and does so for the purpose of pandering to blacks? He's bullet-proof. He'll probably have a long and successful political career.

The case will be kept active, but never prosecuted, for as long as possible. As soon as the charges are dismissed, the lawsuits from the supposed rapists will start, as well they should. By keeping the kidnapping and assault charges open, Nifong maintains some leverage too keep them from filing suit.

Kidnapping, huh?

Really now.

If you hold someone who wants to get away, that's wrongful imprisonment. If you take that person somewhere she doesn't want to go, that's kidnapping, whether you're dragging someone across the hall or through a door or out of a chair. There is no minimum distance for a kidnapping charge, and it's the difference between a misdemeanor assault and a serious felony.

It's not uncommon for a purse-snatcher to be charged with kidnapping because, in the act of snatching a purse, he dragged the victim a few steps. That's usually the act of an overreaching prosecutor, and that certainly appears to apply to this case.

I think I may have heard a vagrant on the side walk say that one of the defendants' cars was double-parked. Or I might have if I had been in Durham in the past three years, which I haven't.

Think of it as "fake but accurate."
