A private laboratory hired by the prosecution in the Duke lacrosse case failed to report that it found DNA from multiple males in the accuser's body and underwear, according to a defense motion filed today. The lab, DNA Security of Burlington, found that the DNA did not match the three defendants, their lacrosse teammates or anyone else who submitted their DNA to police, including the accuser's boyfriend.

The new evidence emerged in thousands of documents handed over to the defense in October.

Can Nifong do whatever he wants, trample on innocent mens' rights, hide and manipulate evidence, all with no repercussions? Just what is the difference between Nifong and Uday Hussein?

Somebody stepped on Uday. Not wishing the same fate for Nidong, but his career should be toast as a minimum.

Yep a pretty weak CYA attempt in my view. He is finished as an expert witness and deserves to be.

I think we should start a new word . . .

Recent news report of three "climbers" lost on Mt. Hood had me thinking about it all wrong.

Defense wants rape case moved

Lawyers defending three Duke University lacrosse players against rape charges have asked that the case be tried outside Durham County.

Defense lawyers filed their request for the change of venue in a Durham County court this morning just before a hearing was set to begin on several motions involving the case.

"The defendants do not seek to change venue in these cases merely because there has been publicity, nor do they seek trial in a location in which no publicity has occurred," the lawyers said in their motion. "Rather, what the defendants seek, and what they are entitled to under the Constitution, is a trial in a community which has not been polarized by pre-trial publicity or torn apart by the circumstances of these cases. Regrettably, Durham is not that community."

I think it's more important than ever to identify those other 5 men who contributed. They certainly are not innocent candidates for Meehan and Nifong to protect unless....they're already known. HA

..."even Greta last night was implying that maybe one of the Dukies was the Dad."

I caught that, too. Disgusting. I could not believe they are still interviewing the he/she Jakki. Anything for ratings and to keep everyone watching.

" He said he and Nifong chose not to release the full report to protect the privacy of lacrosse players who weren't implicated in the case. "

This makes absolutely no sense.
But, then again, we're talking about the Durham legal system.
If none of the player's DNA matched-how is revealing that fact a violation of their privacy ?
Or is he trying to infer that DNA matched Duke players who were not indicted ?

The saga of the Duke sperms magical mystery tour....or detour

Like I said above, if they are going to try to insinuate in any way (for the dumb among them) that one of the players might be the father, that's going to come awfully close to Specter's "Magic Bullet" theory.

Since Greta's interview of Jakki, which was filmed sometime in the past, I thought she was using that implication as a ploy to get Jakki to open up and provide more info.

Greta's withholding the news of the pregnancy may or may not have been either manipulation of that news or her complying w/a defense request.

I bet that Nifong is going to claim that the other DNA isn't relavant, and that's why he withheld the information.

Did you hear the rapist's cousin on Greta's show? They said that the accuser had been kept away from her family, and that she is now pregnant from the rape. So, this is Nifong's ploy, he thinks that he's going to wait until the kid is born and do a DNA test and prove his case, but just in case one of the lacrosse players doesn't turn out to be the father, he's hiding the woman, so that he won't have to do an in uterine paternity test.

He can't be doing that since none of the 46 players' DNA matched ANYTHING.

Attorneys knew of accuser's pregnancy
Updated: 12/15/2006 11:02 AM
By: David Scott, Associated Press

DURHAM, N.C. -- An attorney for the defense says they've known for some time that the accuser in the Duke lacrosse rape case was pregnant.

Joseph Cheshire spoke briefly before Friday morning's hearing in Durham.

News of the accuser's pregnancy comes roughly nine months after the team party where she says she was raped by three men.

Fox News and WRAL-TV in Raleigh reported the woman gave birth Thursday night, but Cheshire says he's also heard that the woman hasn't delivered a child yet.

Durham — The judge presiding over the Duke University lacrosse rape case on Friday sealed the military and medical records of the accuser.

Judge Osmond Smith ruled in a closed-door meeting with prosecutors and defense attorneys that the defense could review the files, but that the information wouldn't be made public.
