Defense wants rape case moved

Lawyers defending three Duke University lacrosse players against rape charges have asked that the case be tried outside Durham County.

Defense lawyers filed their request for the change of venue in a Durham County court this morning just before a hearing was set to begin on several motions involving the case.

"The defendants do not seek to change venue in these cases merely because there has been publicity, nor do they seek trial in a location in which no publicity has occurred," the lawyers said in their motion. "Rather, what the defendants seek, and what they are entitled to under the Constitution, is a trial in a community which has not been polarized by pre-trial publicity or torn apart by the circumstances of these cases. Regrettably, Durham is not that community."
