Lab in lacrosse case found many DNA sources (DUKELAX)

A private laboratory hired by the prosecution in the Duke lacrosse case failed to report that it found DNA from multiple males in the accuser's body and underwear, according to a defense motion filed today. The lab, DNA Security of Burlington, found that the DNA did not match the three defendants, their lacrosse teammates or anyone else who submitted their DNA to police, including the accuser's boyfriend.

The new evidence emerged in thousands of documents handed over to the defense in October.

Did they order a DNA test for the baby?

How would Nifong KNOW or BELIEVE when Mangum became pregnant if he hasn;t talked w/her?

It looks like Nifong doesn't have anything on Meehan because if he did, Meehan would lie like a rug. So, it was "money" for the lab.

What bothers me is What's the "chain of custody" for the samples? It could get tricky. Anyone who handled it could have contaminated it. Meehan obviously used his DNA as a "contamination" check. DNA from ANYONE who handled it would have/SHOULD HAVE been submitted.

The DNA data was not ever given to the defense; they had to ask for it and even then they didn't get all the underlying data.

Cheshire is saying that Nifong and Meehan DECIDED not to include exculpatory evidence.

Can Nifong be required to testify as to HIS part in the chain of custody of the evidence? (Didn't he deliver it to the lab?)

The motion filed this week is a more substantive motion because it contains information from items received in more recent discovery turnovers -- such as all the information from DNA Security and the Himan/Gottlieb reports.

The suppression motion originally filed by Reade Seligmann's attorney laid out why the 4-4-06 photographic lineup was improper, but did not delve as much into how it taints any in-court identification by CGM. The new motion lays out the taint argument in devastating detail.

IMO, the key point is that Judge Smith has ordered a full-blown suppression hearing, which means that the Himan-Gottlieb combo will have to take the stand and face questioning regarding their conduct in this case.
