The motion filed this week is a more substantive motion because it contains information from items received in more recent discovery turnovers -- such as all the information from DNA Security and the Himan/Gottlieb reports.

The suppression motion originally filed by Reade Seligmann's attorney laid out why the 4-4-06 photographic lineup was improper, but did not delve as much into how it taints any in-court identification by CGM. The new motion lays out the taint argument in devastating detail.

IMO, the key point is that Judge Smith has ordered a full-blown suppression hearing, which means that the Himan-Gottlieb combo will have to take the stand and face questioning regarding their conduct in this case.

If she is due in February, I guess we know why the trial will be "in the spring."

Can you say more about the suppression hearing? I thought that was about her medical and military records.
