Delta can't pass rules in violation of state law. Vermont State law protects public breastfeeding. The plane was on the ground in Vermont....

Florida has a similar law.

I'll spell it out for you. Page 11 of Delta's Contract of Carriage:

Delta may refuse to transport or remove passengers its aircraft in any of the following situations:

4) When the passenger fails to obey any instruction of any member of the flight crew.

And the fact that the rules he cites provide no legitimate basis for the flight attendant's "instruction" to cover up the kid. It's not a safety issue: Delta's website says that infants can be held in the parent's arms during takeoff. It's not an "offensiveness" issue, since the mother was in a window seat, with her husband on the aisle -- a passenger would have to be craning pretty hard to be offended.

And now we know the reason for the protest. The flight attendant was STUPID. Thus, the flight attendant is being disciplined. I think he/she/it should be fired for causing all this bad press for an airline that can't afford to lose passengers.

The state of Florida does not have jurisdiction over Delta Airlines corporate policy, sorry. That would be the FAA you're talking about and they're federal. You see Chance, planes fly all over the fifty states, don't they? In fact genius, they fly all over the world.

Florida has laws respecting some state birds too. Doesn't mean Delta has to let them be carried on their planes. Geezee...

Don't think so. Those pilots who were caught drunk on the runway in South Florida were to be prosecuted in a Florida Court, not a federal court.

Two America West pilots accused of trying to fly drunk on a Phoenix-bound flight from Miami last year are scheduled to be tried in Florida state court on July 7.

FAA also pulled licenses, separate issue.

A court in Florida, US has found two former America West pilots guilty of operating an aircraft full of passengers whilst being drunk.

Thomas Cloyd and Christopher Hughes were convicted on one count each of being guilty of operating an aircraft while intoxicated or in a reckless manner. The two men, who will be sentenced on 20 July, face a sentence ranging from probation to five years in prison, Reuters reported.

The two former pilots, who have been dismissed by the airline and lost their pilot licences, were arrested on 1 July 2002. Florida court finds America West pilots guilty

Relax. I am not judging you. I believe you are taking my point out of context.

I was merely pointing out that to demand that a breastfeeding mother use "a bottle out of consideration for others" was assuming one's definition of a considerate act to be universally held, which is not true.

Nor does the state of Florida have jurisdiction in Vermont, where the incident took place. Delta Airlines, however, is required to abide by the laws of the state on the ground of which its planes are currently located.

That would be the FAA you're talking about and they're federal.

But Burlington International Airport is owned by the City of Burlington, not the FAA or the feds.....

In fact, it looks like the law would apply even if the plane weren't on the ground.

Airspace Rights

The federal government has jurisdiction over airspace within its domain, and each state has authority over the space above the grounds within its borders except in places within the domain of federal regulation. An aircraft is subject to the authority of the federal government and to the authority of a particular state while traveling over it.

Probably doesn't matter. 7 of the 8 flight attendants I had on my flights this weekend liked men.
