In the Libby Case, a Grilling to be Remembered

With withering and methodical dispatch, White House nemesis and prosecutor Patrick J. Fitzgerald yesterday sliced up the first person called to the stand on behalf of the vice president's former chief of staff.

If I. Lewis "Scooter" Libby was not afraid of the special counsel before, the former Cheney aide, who will face Fitzgerald in a trial beginning Jan. 11, had ample reason to start quaking after yesterday's Ginsu-like legal performance.

If this expert witness was so clearly shown, by Fitz' withering attack, to have mis-remembered and forgotten all sorts of details...

Doesn't that make Libby's defense look all that much more reasonable? It merely shows that everybody can have moments where you forget about various details, or remember things wrong, or later recall something in clearer detail.

I don't see why that's a crime.

My God, all the issues such as increased taxes, Pelosi as Speakerette, Supreme Court Judges, pull out of Iraq and the border remaining the joke it is, all these are the issues that the filthy Post refuses to address. Traitors run that rag! Fitz has had a free ride and the President should pardon Libby and see that Armitage is prosecuted, the world is coming to an end with a wimper, not a bang. Where is the investigation on Dirty Harry? Very discouraging that the American people will vote for the Democrat scum because the media pushes their agenda and trashes the GOP.

Remember the fuss when Slick Willy issued a few pardons before leaving office?

He didn't "issue" them. He sold them. People paid Roger Clinton, Hugh Rodham, and an enclave of criminal hasidim paid Hillary in votes after they were pardoned for ripping off federal school funds for decades.

Have the Puerto Rican terrorists Bill pardoned blown up any more cops since they got out? Have the cops they already blew up come back to life yet? Oh well, when Hillary needs the Puerto Rican separatist vote, Bill delivers.

There were several moments when Loftus was completely caught off guard by Fitzgerald, creating some very awkward silences in the courtroom. One of those moments came when Loftus insisted that she had never met Fitzgerald. He then reminded her that he had cross-examined her before, when she was an expert defense witness and he was a prosecutor in the U.S. attorney's office in New York. Libby's defense team declined to comment.

Had to get to the end to read this peach...It was worth it.

I think that just helps Libby prove his point, that memory is not reliable.

About 600+ times, including all variations of it. Thing is, I'm astonished that Libby, Rove et. al. haven't figured out how to do that. "I can't remember" is a pretty simple phrase to commit to memory.

The Concord, N.H., Monitor points out Libby represented Rich during the '80s and '90s. Rich was the target of a 65-count indictment for various crimes, including trading with Iran amid the American hostage crisis and tax evasion. He was convicted in absentia on 51 counts.


Libby reportedly collected $2 million in fees from Rich during the time he represented the financier, who fled the country rather than face the charges.

Around the time of Clinton's 2001 pardon of Rich, his wife, Denise, donated more than $1 million to Democratic causes, including $70,000 to Hillary Clinton's 2000 Senate campaign and $450,000 to the Clinton Foundation.

While Libby denied having any involvement in the pardon, the Monitor reported, he did call Rich Jan 22, 2001, to congratulate him on his good fortune.

"Libby's powerful presence inside the White House – his title was assistant to George W. Bush as well as chief of staff to Cheney – might help explain why the incoming Bush administration failed to pursue obvious threads of corruption trailing out of President Clinton's pardon of Rich and other dubious figures," the paper conjectured.

Some see Hillary Clinton's denouncement of Libby as more than ironic, since Independent Counsel Robert Ray accused her of giving false testimony during his probe of the White House travel office. In addition, her husband was impeached by the U.S. House of Representatives based in part on a plea bargain deal he made with Ray that included the admission he gave false testimony under oath to a federal grand jury about his relationship with White House intern Monica Lewinsky.

Is this an article or an op ed? Disgusting the support for Fitz on a case that now is about nothing. Plus on cross exam, one should only ask questions that elicit a favorable response for the questioner. Is there any reference to the direct testimony?

Contrast this with how Ken Starr was portrayed as an absolute sicko.

The judge is deciding whether to allow testimony by this "memory doctor". I'm guessing not now.

I like Libby, and hope he gets off, but I do have a disdain for these types of expert witnesses, so I am amused at how she faired in court.

I didn't read the whole article, but the expert testimony being permitted has little to do with the expert forgetting a previous examination by Fitz. The issue is whether it is a recognized reliable scientific specialty that is pertinent to an issue in the case and for which the jury needs to hear from an expert. Does the article address any of that?
