It is, but a Federal law (sponsored as a bill in the House by Foley) makes it a Federal crime to use the internet to solicit sex from a minor, irrespective of local age of consent laws.

(Which leads to the question of whether an e-mail from a husband to his 16 year old wife duely married under the laws of DC or Kansas signed "NORWICH" is a violation of Federal law, but I digress.)

So he was either 17 or 18 when those IMs happened. Which is it? If ABC is reporting the IMs are from 2003, they're not being specific enough. What month in 2003?

Oh, enjoy away...I'm enjoying too. I just have some skepticism that the media will admit they lied and that this aspect of the story will get out. I don't think the media can afford a backlash against Democrats with only 34 days to go before the election. We'll see though. The force of Fox and the alternative media may force media play on this just like with Rathergate. Anyway, I'm happy tonight too after feeling a bit hopeless and deflated after listening to this story all day. So don't let me stop you!

Well, it was a former page of his, so that part is kind of creepy, but yes, he wasn't a current employee, so there's technically no rule against that.

As for his age, it appears that while they started their friendship and IM conversations before the "kid" turned 18, the stuff that would have been illegal with a minor didn't happen until he was after 18. Thus, no crime.

It seems more and more like this is just the Dems outing a creepy gay man.

So the "outrage" over the Path to 9/11 was just cover - a plan to distance the ABC Media outlet from the Democrats.

I think the folks at the DU would much prefer this election be about Foley than about protecting the nation from Bin Laden. I think what you'd hear at the DU is "Focus on Foley. Bin Laden being the focus means death for our party hopes in November."

That thought had occurred to me. This guy got warned about e- mails, so his enemies knew he had a history. Why would someone in his position and post something that could come back and haunt him. Then he checks into a rehab. Maybe he sent them. Maybe he didn't but thinks he did. Lot's of maybes.
