Indict the New York Times ("The Newspaper Of Record[ed] Treasonous Acts")

It is an article of faith on the Left and among its fellow travelers that the Bush administration stole two elections, made war on Iraq for venal reasons, tortured hapless foreigners, and conducted illegal surveillance of innocent Americans. A corollary of this mindset is that the press, primarily the Washington Post and The New York Times, has a right, indeed a duty, to print whatever they want about the administration—even if the information compromises national security. Not true. The press is not exempt from laws that apply to everyone else. The press is not exempt from laws protecting our national security. The New York Times is not exempt from the Espionage Act, as we shall see in a moment. First, an Espionage Act indictment of The New York Times would not even remotely constitute an attack on a free press. As Justice White wrote in Branzburg v. Hayes, “[i]t would be frivolous to assert . . . that the First Amendment, in the interest of securing news or otherwise, confers a license on either the reporter or his news sources to violate valid criminal laws.”

Henry Mark Holzer, Professor Emeritus at Brooklyn Law School, is an appellate lawyer who specializes in constitutional law.

He also co-authored "Aid and Comfort”: Jane Fonda in North Vietnam."

I fear that much as Holtzer accounts for the reason Fonda was never prosecuted (though there appears to have been ample probable cause) at the time was the Nixon Administration's reluctance to charge a highly popular movie star, I believe the Bush Administration (as evidenced from the past 6 years) will not want to touch this with a ten foot pole.

It is a sad commentary that when some flunky, Jane-Bond-Wanna-Be, get's "outed" (yes, La Plame Affair) there is no reluctance to bring the full weight and might of our Justice System to find and punish the evil doers--even if it takes years, costs millions of dollars and harms countless of innocents.

However, when there is prima facie evidence that Espionage/Treason "HAS" occurred (not once but at least FOUR times in the past year) with the leaking of the NSA Wiretapping Program; the CIA's holding prisoners in foreign countries; the gathering of financial information about terrorists transfer of funds from institutions worldwide; and now the latest leaks of the NIE, WHY, in God's (or the Devil's for you non-believers)name is no one in the Justice Department even "whispering" criticism--much less threatening (and in fact calling for) an investigation.?

I can understand W's reluctance to even suggest such as course of action, however, where is the Attorney General, Gonzales?

He and Mueller are probably preoccupied with coordinating with CAIR regarding the next scheduled Muslim "sensitivity training" seminar for their FBI Agents.

Moreover, where are all our Congress-critters?

Especially, those paragons of virtue and righteousness, such as Chaffee and "Spectre?"

Maybe they (and their Dimocratic brethren) are too busy drafting amendments to bill which would give our enemies Habeas Corpus to be bothered with such trivial matters such as this?

Or is it they are all hiding under their desks for fear of the crap-storm which would surely ensue should ANY dare to take on the darling of the left's Primary source of garbage and propaganda?

Of course its a given the the RATS won't call for hearings, but is there not ONE Republican who has the stones to insist that Congress investigates this serious matter?

Why should they bother gathering any intelligence info about us, all they have to do is subscribe to the NY Slime or WaPo

Aid and Abetting, that's the screed of the Dims and (sadly) some RINO's as well as Bush-haters within the administration--especially, the CIA and State.

They should be rooted, booted, prosecuted, and incarcerated for a very long time.

Still it would appear those militias would target the mainstream mess and not the Clintons for their reign of terror?

The 1st Amendment supposedly guarantees both freedom of the press and religion.

We have foolishly allowed it to evolve to a condition where a newspaper can seriously harm national security, yet a student cannot say "God" in a public school.

""I'm and Infidel and Proud Of it!!" Buy some iron on transfer sheets and make them on your printer. I have made many personal T-shirts that way. It works and looks very good. It isn't expensive, about a buck a sheet (8x10) and the price of a good T shirt.

Might just do that and wear it to the next CAIR rally, seeing as I live in Virginia and there is a hotbed of Moozie activist in and around DC.

There is already an "Infidel" t-shirt available with the word in Arabic and English. I am about a day away from putting to bed a bumper sticker that might interest you. $2.50 each (plus the cost of mailing it/them priority mail) and $150 goes to an informal group that sends stuff to men and women in the combat zone. You'll have to take my word on the money because I'm not going to take the trouble to get all official.
